long story so will cut to chase my old boss made me sign as a guarentour for 200k (I thougth it was just as witness)of equipment and went bankrupt 7 companies after me for money trying to fight but cant prove I didnt sign as guarentour so sold my house and blew the 20k that I made from house. with Debt management company for my personal debts and dont earn much. no spare cash. got to go to court again as they are trying very hard to get their money is there anything they can do except make me bankrupt as that would do me a favour! (have no house now, car only 2k no savings and 12yr old child)

That's good news Isobel and hopefully will let these companies know that chasing you for these debts will only waste their time and money.

hi all,
well Monday went ok not bad but not great. The barrister for the leasing company said that he was withdrawing this as he wishes to pursue this at trial but as I refused to vacate Monday he is charging me £1000. I replied that Thursday night was too short notice and was very scared that they are taking to me trial. The judge agreed that I would not have to pay costs and they should pay mine!(lol) she explained that she doubts that it will get to trial with the evidence I have produced ( i gave them proof of sale of house and that I have no money) but could not garentee that. so speaking to bankruptcy experts and they all say go bankrupt it will do me a favour and I have nothing to loose by doing so. Thank you all for you support great to have somewhere to turn for advice

UPDATE: panic over - spoke to a friend at the courts and found out they are only trying to stop mondays hearing because they are scared they do not have a case, I have been told to submit my bank statements and attach my earnings V bills so that they can see you cannot get blood out of a stone and threaten brankruptcy (friend is specialist in this feild) so will update after hearing

Hi all,
ok bit scared now, got a letter by email saying that they want to vacate the summary judgement on monday and want it to go to trial! I rung them and asked to explain and they say that they have a very strong case against me and have witness statements saying that I was offered a directorship to sign these forms (which is a lie I was never offered or have a directorship) and think that I signed with intent. I told them again I have no money which is true but they say that they have checked with land register and I still own a house (which is untrue I have checked) and that at trial they will ask for an attachemtn of earnings but I said that I was with a debt management company and had no spare cash! what do I do shall I go on monday anyway and try to defend myself although I feel I am gogin to be ripped to pieces or agree to a trial and go bankrupt quick really scared!

Tbh, I would make sure you are up to date with all your other payments & sit tight. I thought as a guarantor you had to have the money to back it up & you obviously didn't. If there was no financial incentive to you to sign I am sure you have a strong case about signing thinking you were a witness.

well yes but one of them will get me some how knowing my luck even the CID said I dont have a leg to stand on because I cant prove I didnt sign at a guarentour and thought I was only signing as a witness (a trusting employee who was asked to sign a peice of paper by boss and stupidly didnt read it properly!) but if all cases are dropped I wont have to go bankrupt just want to get my life back anyway thank you everyone for all your kind advice watch this space!

Thank you all again for your responses. I have a feeling that I will have to pay to go bankrupt but there were two reasons why I didnt 1 pride as I am innocent! and 2 If they want any money from me they can pay for me to go bankrupt only to find I have none! (hopefully when they realise I dont have anything they will go after the other people that have all signed the same thing and they have houses etc! Since my last post I have been to court and 3 of the 7 cases have been dismissed and they have written saying they are dropping the cases. Another one has been proved that the witness who signed the document I signed was a fake and that case has also been dismissed! The next case is on 2nd feb for 15k so will let you all know how I got on, thank you

sorry to be to the point, you first posted 6 months ago and requesting advice and help

some of the people on this forum offered suggestions, Including some of the same people who have posted on this occasion, At this time one of the experts may have had a plan B.

I hope that someone is able to offer a plan B, but from the information that you have posted, I would really try to save and make yourself BR, it will stop lots of phone calls and aggravation.

I do hesitantly post this< iam not knocking you just trying to be realistic with your options

For your own peace of mind it would be work looking into your options now. The longer this is hanging over you the worse it will seem.

Speak to one of the experts who post on here (details in the experts section at the side of the page) or have a look on www.iva.com and contact an insolvency practitioner who will be able to talk through your options with you.

Creditors don't normally declare people BR due to the cost of the process. They could:

- sell the debt to a debt collection agency
- take you to court for a CCJ and force you to pay a certain amount

I would recommend you try and face the debt rather than waiting for the creditors to take steps. I am not saying that you should declare yourself BR but it may be worth looking into your options now rather than when you are forced to look into them.
