Posted - 24 January 2010 : 19:32:29 Hi , i was under the impression that when myself and my wife ( both bankrupt ) were to be offered the BI in our home it would be £211 + £1 + £1 as the property is in substantial neg equity . The case worker has now sent us the BI forms and is asking us each for £211 + £1 We were both discharged Oct 09 and the house is the only thing thats left to be sorted out .
Does anyone know of a something i can print out to back up my thinking and send it to the case worker ???

Posted - 25 January 2010 : 11:07:28 Hi Digman, we recently bought our beneficial interest and it cost £211 + £1 + £1. The 211 went to tlt solicitors and the other went to the OR. Good Luck :-) |

Posted - 25 January 2010 : 10:56:38 I would have thought that there would be no reason why bthis cannot be done on one document, and hence only £213. Call and ask. If they say it has to be two documents, get them to explain why and come back to us here.

I have to say, I hope that you are right on this
I had thought that as it would require two deeds of assignment then it would be double the fee!
I will have a look tomorrow and in the meantime, maybe Steve Thatcher will see the post and, as a solicitor, he may have more immediate knowledge.
I will be interested to see what emerges.

i appreciate what you are saying and i too have read the afore-mentioned booklet but i am sure i am positive in thinking that i can by my wifes BI and she can buy my BI in the same transactionwith one set of solicitors fees .. If you search on the site for 'beneficial interest £213' there are previous posts relating to this . John from EJS has replied to another members posts saying it is £211 + £1 + £1 ..

There is an Official receiver booklet called, "What will happen to my home?" You can obtian this from the Insolvency Service website.
The cost of purchasing the BI for £211.00 plus £1.00 if it is in negative equity, relates to each party - so I am seeing that you are both buying the BI, then it is double - so the case worker is correct, I am afraid.
I wish you well and it is a small price to secure your home - but only do it if you can afford the mortgage afterwards, Good luck, Richard
