Posted - 25 January 2010 : 18:08:10 My husband died on 1/1/10. We lived on his disability money, carers allowance, income support and £40 pension I received from the police. I do not work at present have debts of £12,000. should I go bankrupt now to get it over with or fight with the companies over whatever benefits I might get until I feel able to work again and can get a job. Will I lose my pension? Would that be a minor setback in the long run? |

I am so sorrry to learn of your sad loss and my thoughts are with you and your family.
As kallis has said follow the link and come back after you have looked at that site.
I think it may be helpful to contact your local CAB, make an appointment and take with you your paperwork and I am confident that they will be able to guide you.
Whatever you do, please do not make a decision in panic. You must take advice and move forward at a pace that is sustainable for you.

Posted - 25 January 2010 : 18:55:19 Hi Jan, thanks for that. I had never heard of Debt Relief Order. Having problems with benefits at the moment. Income support say I no longer get this from date of Paul's death. I still get carers allowance for 8 weeks but in getting this I cannot get bereavement allowance. I cannot get funeral payment as getting carers allowance (this cannot be stopped prior to the eight week rule) I have a funeral bill of £2047.00 which the bereavement grant will pay most of it. Other than that, my pension of £40 per week will be my only income until I find what benefit I am entitled to. So at the moment I dont know what disposable income I will have. Should I wait until all this is sorted which will be another 6 weeks approx or go to CAB now. Mind all over the place at the moment and dont know what to do when to be honest. Scared of getting into trouble with anyone and very depressed.

Posted - 25 January 2010 : 18:44:05 Hello, and I am so sorry to hear your sad news.
If these are the only debts you have, and you don't own your property or have any assets then you may be entitled to get a Debt Relief Order. This will cost you £90, last for 12 months and as long as you don't have more than £50 disposable income a month you should be ok.
