Posted - 28 January 2010 : 18:56:24 After several posts on here and having received some great advice, i am declaring BR in April, after moving house and reassessing my I&E.
My ultimate concern is that the OR will take a dim view of the circumstances that have led to my position.
To summarize;
At the beginning of 2008 myself and my ex-partner seperated, she refused to support me paying the mortgage and I kind of went a little off the rails and also stopped paying too. The house was reposessed by Northern Rock and sold for 75k (mortgage outstanding around 95k) we also had 25k unsecured loan (we took this out to clear some of our debts we had from the distant past and pay the deposit on that house) with NR that was part of their 'together' mortgage deal which I/we also stopped paying. In addition, I had a lease car that cost £386 a month which I could no-longer afford, this was (eventually, after 4 months of not paying) reposessed, and they are now claiming a 7k shortfall. I also had personal loans/CC debts with First Direct that I ceased to pay.
I have moved house several times since this period of turmoil, which has meant the creditors have struggled to track me down...so i haven't acknowledged or paid anything towards my debts for close to 2 years. I propbably could have paid something, I just thought I wouldn't as they couldn't find me.
Will the OR view me as wreckless and impose a BRU/BRO? Is there a risk i may even be REFUSED my BR petition?
Very worried!

Sorry to hear you've been having a bit of a rough time. Hopefully, you can now start to sort things out and come out the other end with more peace of mind. I wouldn't worry too much about the OR. I personally had incurred some of my debt through gambling, which apparently is frowned upon much more so than just spending money on expensive goods, holidays, etc for some reason. I am due for discharge in 5 weeks time and so far, I have not heard anything about getting a BRU, which to be honest, I was more or less expecting. Maybe it was because my gambling debts weren't excessive compared to some or maybe it is because I have taken steps to get help with my gambling problem or maybe I just had a sympathetic OR, Who knows! At the end of the day, it is down to the OR, but I would imagine from what you have said in your post, he would need to be a particularly harsh OR to subject you to a BRU.

I guess I am panicky as BR is a big step. But I am confident I am doing the right thing. I am just conscious that I have made some bad decisions in the past and worry I will be hit with them by the OR.

the OR is not an ogre. from what you have typed you have done no different to many of us, trying to avoid BR by robbing Peter to pay paul.
A BRO / BRU is extreme cases when someone has used money that should have gone to OR and say gambled or been totally reckless with money on what you have typed relax , your case appears a normal BR.
the Or may ask why you took so long to declare Br or why you moved so often but you already have shown an answer
