Posted - 11 February 2010 : 14:45:54 I`m due for an automatic discharge from my bankruptcy in the next month but the Bank who were one of my creditors are now chasing my wife for approx £6000.00 as according to them she was a partner in my business (she wasnt otherwise HMRC would no doubt be after her aswell). As far as the business account was concerned, she was able to sign cheques and draw money out. Theyre not interested in my accountant telling them I was a sole trader so I tried the OR, theyve told us to send all the threatening bank letters, plus the debt recovery agent who the bank passed it onto, to them and apparently they`ll deal with it?
Sound too good to be true but the OR aren`t too happy with LTSB as they are also trying to claim the exact same amount of money from my `estate` - is this a last ditch attempt to obtain funds before my discharge or can they actually sue my wife?
Just as we thought the future looked brighter!

Don't worry or know that worrying is as effective as trying to solve an algebra equation by chewing bubble gum.(Baz Lurhman) RevivaUK and Paul Johns helped me through it all i can't recommend them enough!!

hopefully the OR will sort it out...

Posted - 11 February 2010 : 15:02:19 as far as i am aware if she was not a partner in the business or had signed personal guarantees for business debt then she cannot be persued for such debt many businesses have signatories for cheques who are not liable for the finances of the company
