Posted - 12 February 2010 : 06:20:04 My partner and i split up in 2008, i went bankrupt in oct 08 and was discharged april 09, property was repossessed and shortfall included as well as joint overdraft in my bankruptcy.
My partner has outstanding debts from the repossessed address and has not done anything to sort out payments etc. outstanding shortfall, joint overdraft, utility bills plus other debts,sky etc. when he left the repossessed property he had already had letters threatening court action etc. 18 months down the line a debt company has now traced him and i see no other course of action than for him to go bankrupt.before all the others trace him as well
could it be that any of these companies could have taken him to court and issued ccj's. if so and he has not responded to the ccj's could bailiffs be instructed.
if he goes bankrupt would this cancel the ccj's and any bailiff warrants?
how would he find out if any ccj's have been issued?
could the bailiffs turn up and enter the property even though the tenancy is in my name and everything in the property belongs to me. even though i have not got proof of purchase for a lot of the contents.
he is now out of work and has been since early december, was self employed in the construction industry.
