Posted - 17 February 2010 : 13:49:26 Hello my friends
I am waiting for a compensation pay-out due to an accident nearly 2 years ago.My solicitor has given me the amount that I have been offered but is awaiting the separate amount for loss of earnings. I know the general compensation money is mine to keep, but how do I keep it? What bank account can I put this money in..or do I ask to have the money put straight into my fiancees account? Or do I keep it as cash somewhere safe..?
The other question is, the loss of earnings money Ill be given is generally not mine as the OR will have interest in it. Can I however use some of it to pay the BR fee? I am due to declare BR soon, hopefully March.
Any advise on this anyone?

Posted - 18 February 2010 : 08:28:00 Hi again and thanks for reply
I am a little confused and disapointed.I did a search for prev post reg injury claims and the mostly say the OR only has any rights to loss of earnings money. Have rules changed recently? I wount go on a cruise with my injury money but was hoping to purchase few items for the home/furniture+ general home improvements etc.
And a visit to the dentist have have painfree nights would be on the wish-list too.
It looks like I should stop dreaming about this and hand it all over wether I get my comp before or after BR..?!?

Posted - 18 February 2010 : 01:46:04 money received before BR and spent unwisely or given away would be seen as grounds for BRO by the OR officially you should have used it pay off your debts, not given it away or gone on a cruise after BR the loss of earnings money would be seen as a windfall and is the property of the OR and not really yours to spend another point is that i think any sums of money received pre BR even comp for injuries may still be viewed by the OR as money you should have spent towards debts and may want to see where it went not 100% sure on the last point but maybe Paul or Mel will confirm or rebut it

if you receive compensation money pre BR then you can use it as you wish ie. living expenses BR fee new washing machine etc. just be prepared to explain where it went to the OR if on necessary things no problem if on alcohol and gambling expect a BRO

Hi and thanks for you reply.
So from what you are saying, if I receive my money BEFORE I declare BR I can use it however I wish!? Its mine to use and if I so wish I can give it all to f.ex my fiancee? Apart from taking off the BR fee money?
But if I receive the comp money AFTER I declare BR I must tell the OR what the 'loss of earnings money' went on and it needs to be legitimate causes etc.
