Posted - 18 February 2010 : 01:19:26 My selfy amd my partner were declared BR on the 29th January 2010, we have a meeting tomorrow with the OR ( Which I am not looking forward to!!) today we have recieved a visit from someone saying that they work for a firm of Solicitors and they are interested in helping us........ he says that they can anul the BR, and clear the records by offering us an low cost loan, has anyone else had a visit from these sort of people and can anyone advise us on this processs????? |

they should give you written feedback on the amount to pay for the IPA.
you can appeal and ask them to clarify how they got to a certain figure.
ultimatly if no agreement it goes back to court (?) for a decision but for it to go that far it is very remote and rare.
if you aint happy (as it reads that you are not) then keep pressing them for a breakdown of the figures
keep posting as you will have a lot of letter tennis with them

Have been to my OR meeting today, It was all going good till about half an hour ago, The OR has called me to clarify a few things and it turns out that me an my partner are going to be looking at paying 300.00 back!!! I dont understand considering my Income and Expenditure calculations were leaving me with - 91.00 and my partner with 137.00!! I was under the impression that they only used 50% of what we had left, so I'm wondering where my OR has found a surplus of 600.00, has anyone been in this position and how long have I got to pay this back!!! help!!!!!!!!!!!!!!!!

as chester suggested ignore them, if they are that interested in helping you , would they lend you an intrest free loan with no payback required ?
any one can have their BR Anulled within the first three months as long as they clear all of the debt that was declared at the time of bankruptcy.
potentially the reason you decided for BR was that you could not afford to manage your debts so you took positive steps to deal with your situation, you are now debt and hopefully stress free.
if you were forced into Br by a creditor, you may have some mileage in getting a loan but be selective which company to use then check the small print and APR
just think how long you may end up tied into one of these low cost loans (tens of years).

Posted - 18 February 2010 : 01:34:15 these sort of companies trawl the insolvency register to prey on recent BRs to offer their services which will be at an exorbitant rate to make them a lot of money my advice would be to ignore them and bin the correspondence
