Posted - 22 February 2010 : 14:44:05 I am enquiring on behalf of my mother-in-law and her husband. They have accuired debt in both of their names and cannot cover their debt and basic living expenses. We are now subsidising their rent and giving them more money on top of that in order for them to just survive. How will they be treated when declaring bankruptcy as a married couple. Will they be seen as a unit or will they each need to pay £495? Her husband was self employed, but now unemployed due to illness and she is in full time employment. |

it helped with the fee and some other issues I had to resolve

Posted - 22 February 2010 : 15:59:27 me and hubby booked court appointments together but did not even need to see the judge, we just sat around together and then went to collect our bankruptcy orders, we then went together into a private room and spoke to the OR's office on a telephone, they just confirmed details, etc and that was it, job done!
we received a letter with a telephone interview for both of us at the same time and date for the following week, I went first and then passed the phone over to hubby |

Posted - 22 February 2010 : 15:03:43 They would BOTH have to pay £510 to go BR, however they may qualify for a fee remission, see the link for details about this. When we went BR we were seen individually by the clerk but we were in the room together and when we saw the judge we both went in at the same time. The court experience is nothing to worry about, believe me.
