 hi i was made bankrupt in 2005 and discharged

hi i was made bankrupt in 2005 and discharged in 2006 with a bru does anyone know if iam classed as a discharged bankrupt or will i dischaged when the bru ends later this year,if iam already discharged was i meant to have proper papers shown me a discharged and how would that affect my credit rating

Thanks for your help can you tell me what website to look on so ican check whats against my name,does any one know what would be put on my credit record, will it show as bankrupt or should it show discharged.My BRU ends later this year once its over will it still show the information on my credit record or can i get it removed and then restart my credit score from 0 all over again

Even though you have a BRU you are still a discharged BR, although as Richard says you are still subject to the conditions of BR for the length of the BRU.

If you are discharged automatically after 12 months you generally don't get any confirmation from the OR, although you can apply to the court where you were made BR for a certificate of discharge. I think this is £60, although it may have gone up.

Hello and welcome to the Forum.

From what you have said, it seems that you are discharged from your bankruptcy.

However, if you have agreed a BRU with the OR, then you are bound to abide by the restrictions thereto.

they can be:

0 - 5 years
6 - 10 years
10 - 15 years

You will have signed the undertaking and the OR will have signed on behalf of the Secretary of State.

the restrictions preclude you from certain activities for the duration of the Undertaking:

You will not be able to be:

A member of parliament
A councillor
A chartered accountant
A solicitor (partner in a practice)
An estate agent (I think)

You will not be able to:

Borrow more than £499.00 without authority
Be a company director

You can find a list on the Insolvency website.

If you do have a BRU, you will be on the IS website until the end of the BRU

Otherwise you are as free as a bird...

You may wish to look on the website and see what is lodged against your name
