just joined today , have got a right problem at the minute myself and my wife and young family , baught a house Dec2006 , entry date due June 2007 - WASNT READY UNTIL JULY 2008 , the homebuilders have now pursued us for interest of £40,000 from the day we didnt move in until the day they have resold it , they have made nearly £40,000 on our original purchase price , they have our £2000 original deposit , we had tol dthem to resell the house away back in 2008 when we were not willing to move to it for being so unreasonably late , our legal team want nothing to do with it , i have tried MSP'S to no avail , surely homebuilders cant get away with this in a court of law , 3 months late i could take but around 15 months late - wasa no no from us , they made us sell our house so we could move into it once it was originally complete , we coudnt get a new mortgage at that time , so we now had them arrest our wages last week , can anyone advise if bankruptcy will be ok for us , it seems like the only way out !!!!

re horrible developer I got that tee shirt as well
by your comments MSP to i take it that you a north of the border ?
from my experience you will not get much change from developer and if you do start having an advantage through civil court they will start the case again, they have more income to throw at this than an individual, they won my case by default. I ran out of money.
Ian they have the contract fairly well sown up
what stage are the developer at have they petitioned for your bankruptcy or sequestration ie a court date.
if this is the first letter you are still at the early stages of the process, so you have time on your side
i do not know if that developer will petition for BR but they will not let the matter just lie down.
seek advice from one of the experts to the left
I know that Paul at reviva and his team have recently helped someone north of the border
