Can a debt collector/debt coll agency check up on me before I go BR? I.e can they sort of sit outside my house in cars checking who I am with, what I do etc.....? I havent paid my debtors for nearly 1 year as I am saving for BR.
.......or am I just paranoid??? |

unfortuantly you are fair game for the finance companies to chase..
1) you do not have to open the door 2) you do not have to answer the phone 3) You do not have to pass the personal information on the security test 4) ask them to write to you and or Reviva as you have a phone problem
once you do go BR then the phone calls and letters will die down to nothing (within about a month), so try and hold out for another month and then you can start a fresh

Posted - 10 March 2010 : 10:28:50 In my experience, we had NR ringing us up EVERY hour on the hour, starting at 7am until 9pm, even on Sundays, so I unplugged the phone in the end. They were really snotty on the phone and were only interested in us paying up.
Hubby had Picture finance ring his work AFTER bankruptcy asking to speak to him (he had not given them the number, they must have got it from directory enquiries) he just put the phone down on them. Not heard a peep from them since
we also had a debt "counsellor" from NR turn up at the house, we had not asked for this, NR just sent him and then tried to charge us for the privilege! I just told him I was bankrupt and had left the house to be repossessed and I had nothing to say to him and then I just shut the door on him!
so yes, there are guidelines in place, but most debt companies ignore them, that is why I always advise not to speak to creditors at all, it just causes untold stress and misery and if you are going bankrupt, there is no point trying to reason with them |

Although as to what 'late at night' and 'contact you repeatedly' are considered i.e contacting you after 6pm or more than once a day???? |

Yes, I read it here on the forum. Typical isnt it!? I might just about be able to do it end of this mnth...if not I will have to find the extra money from my next paycheck.
Another question to anyone who might know: Do debt collectors/those who get sent to home adresses etc, do they have any rules or laws that they have to obey? I.e do they have any time of day restrictions they shouldnt knock on peoples doors? Their visits could be of bad consequences to the person with likes of their land-lord etc?? I get the impression at least that they are supposed to be discreet...?? Any ideas?

most creditors will threaten the end of the world is coming ! they want communication from you and they think that their debt is the only debt in the world so you must pay them (B********S)
The team at Reviva also helped me by contacting the creditors and keeping them at bay, you should forward all paperwork you receive to the guys at reviva, as they will know if and when the paperwork is getting to very serious stage !
as stated above you have still 8 weeks to court so would not tell the creditors about your plans yet.
BR court date is a great release of the pressure and build up over the past year.

I will continue to keep my head low until I have the money to go BR. It will finally happen by end of this mnth or next!!Its so hard to save the money for the fee's as other things keep going wrong!? Im not alone at least, reading this forum every day!! It seems home visits ARE rare and I just hope I can be left alone another 4-8 weeks. Reviva is helping me and I am almost now looking forward to BR! I so just want to get on with my life. Its so exhausting worrying about debt problems,debt collectors etc!!!!! Totally mentally draining!!

Posted - 08 March 2010 : 16:19:19 Don't worry about people turning up on your doorstep as this very, very rarely happens and is normally just an empty threat by creditors.
If someone does turn up just politely tell them that you are declaring BR and will not be paying any of your creditors. These people are not bailiffs so do not have any right to access your property or take any valuables. If they refuse to leave your doorstep just call the police and say that you are being harassed. |

Posted - 08 March 2010 : 16:13:02 Don't paniceasier for me to say but I never answered the door to anyone for the whole time I lived in that house unless I knew it was a relative/friend, etc. I just kept all doors and windows locked at all times and ignored everybody.
I had changed my phone number too.
If you are going bankrupt, I would not advise you to tell your creditors as they may chase you more, just keep your head low until you do the deed |

Oh GOD, Im really worried now!! What did you say to the big burly guy..??? Do they go away after you tell them what you are planning etc..????
