Looking like Friday is the big day. I have a question about claiming back the £150 court fee, which I can do on grounds of low income.
The refund would be made after I become bankrupt, right? So, how does the OR treat this input of funds? Does he take it for the creditors? Or, will I be allowed to keep it as income and have to declare it on my SOA at ~£13 a month? The latter would not be the best outcome as my surplus income is close to the IPA threshold. Am I obliged to claim the refund?

Posted - 24 March 2010 : 06:31:35 You're not obliged to claim the refund as it is entirely up to you as to whether to claim it or not.
My understanding is that if you complete the relevant form and provide the necessary evidence then the £150 is taken off the fee on the day so you would pay £150 less for the BR fee. I think you can also claim the fee back within a certain time period if you don't have the form/evidence with you on the day you petition for BR.
Whether you claim the reduction or not you may be asked how much money you have in your bank account by the OR's Assistant when you speak to them shortly after being declared BR. If you have, what the Assistant deems, an excess of money then they may claim some of it. This amount may include the £150 if you have pay the reduced fee.
