I am nearing my BR date, but as its taken so long for me to get the money together I now have a few creditors that are really hounding me. One has actually gone ahead with a CCJ..as far as I can tell..and I have had a letter from that court to pay x-amount every mnth to this creditor.(Capital One) Thankfully Reviva is my guiding hand and I hope they 'sort' things out in the meantime. However.... I am now suddenly finding myself abit 'confused' with the effects of BR...??? Please can someone calm me down maybe.....
-even though I will b BR for 1 year or less if early discharge...I suddenly get this feeling its going to 'haunt' me for ever?? Creditors suddenly appearing years after discharge etc...?
-my landlord not being able to get house insurance due to me being BR or ex BR...??
-even after 6 years etc...can I 'class' myself as a normal citizen and apply for a mortgage or be part of a mortgage...??
I am really really depressed today thinking about all this and normally I am the most positive thinking person (gemini) but suddenly I just cant see my future??????
Help anyone?? BR and ex BR.....

You have no need to feel "unworthy" - believe me - debts can be accrued by the best of people - look at a whole raft of the "good and great" that have been bankrupt.
I am pleased that you have the professional support of reviva UK. They will take you through the process and be there to assist you in whatever presents itself. they will be in court for and with you. Do not fret.
Is the date for the BR in the diary now? If so, that is also a positive.
Please forcus on thinking about being debt free and then build for your future.
I look forward to seeing your post that says, "Yes, it is over"

Thanks again for your reply and thanks to all others too.
All my debts are soley in my name and are unsecured. This is sort of why I have always been so afraid of the effects on my fiancee and family. Apart from feeling guilty and 'not really worthy' I just want this to be MY problem and to get past it on my own. Ill be posting soon with the news that Ive finally been to court with money and doc's and my Reviva rep. |

Thank you for your kind wishes about the end of my BR.
You will be fine and if it is only you going BR, that will not impact upon your partner. The debts, I assume are yours and not joint?
Believe me, once the BO is there, life does get better - post back as many times as you need to if you need ideas and again, I say speak to Reviva if you are worried. Richard

Thanks for your kind words, its helped. I wish you just the best for your discharge soon in May and I can only imagine how happy you will be on that day when its official. I can 'picture' my discharge day and can 'feel' the sheer happiness when it happens.... and I have this silly belief that if I can 'imagine it' so realisticly then its whats going to happen.I have always had these thoughts from a small child and they are normally correct.....I just hope this one is'nt going to some sort of cruel trick......

Whilst I understand the feelings of doubt in your mind, I suggest that once you have petitioned for BR, the debt will be gone immediately and you can start to re-build your life from that day.
there will be times when you feel low - those times will pass and by the time the 12 months is over, you will wonder what all the stress was about.
All of us feel the same at some stages of the process. I am nearly discharged - a matter of a few weeks (Mid May)- I am wishing that day to arrive as it has an impact upon how I feel - for the most part, I am back to my old self - confident and happy with a great family, home and a lot to look forward to. You, are much younger than me and therefore have more to look forward to with your family and friends.
Take another moment to think and as I said yesterday, call Paul or Ken at Reviva - I understand they are acting for you and will be pleased to put you at ease...

I am mostly confused...and pretty depressed about the thought of spending the rest of my life having to declare that I was once BR!! Is'nt there ANY point later were I am allowed to put this behind me....or will I basically have to answer 'yes' to those 'have you ever been BR' questions...which will brand me for ever...and lets face it -in a negative way!
Did I read somewhere on the forum that the laws might be amended to help BR people get passed this and not be so 'stamped' for their life....??

I felt really Foggy and confused about what laid ahead.
It does lift, the court is nowhere as bad as you anticipate, treat the court with respect and you will be fine.
it is a huge relief of pressure when the Judge finally stamps the order.
then you will panic about the OR meeting, you will have your expert to support you
And then in no time at all you will be starting to rebuild your life

Yes, there is most certainly life after BR.
I am nearly discharged - It has not been a bundle of laughs, but I am nearly there and I am debt free.
Lots of people in the same position and they come out the other end in one piece!

Sorry that you are having problems. Let me try to assist:
First, if Reviva are taking you through your BR, then I am sure that they will be pleased to speak to you. Why not call their office and speak to Ken or Paul?
Creditors cannot "haunt" you post the BO (Bankruptcy Order). When the District Judge has agreed to the Order, than all your unsecured debts at that date are "gone". You may well receive letters and even the odd phone call post BR, but refer them to the OR and give them the BR reference ABC of 2010 and the county court that dealt with the BR. That will get them off your back. Even a debt that you may have forgotten will be gone after BR (provided it was owed before the Order)
The "norm" is 12 months - sometimes a BR will get early discharge - that is NOT a right - it is a bonus - assume that you will be BR for the whole 12 months.
You will have some damage to your credit rating - unavoidable, I am afraid. You can ensure that post BR the files are suitably marked with the correct details - see Skippys blog for that. But you are over a year away from that so do not stress about that aspect.
As tp your landlord having some problems with insurance - sounds a rall order to me. If you are having problems with insurance that is not too big a problem either. Once you are BR some firms will not want your business. However, there are firms like AXA and others that will be pleased to take the business and give you an instalment plan over 10 months. We have just done this for our Buy to let property.
You will get depressed - that is not unusual. Without suggesting that you start to pop anti depressants at the drop of a hat and forever..., speak to your GP - a short period on sleeping tablets and maybe an anti depressant will assist you, I can assure you.
You are experiencing a life changing time and that will make you sad some days - very sad some days!! But there is an end and you will be debt free.
Speak to Reviva as they are your advisers from what you have said.
