I'd like to ask a question on behalf of my dad who is considering bankruptcy. About 20 years ago he was found guilty of benefit/tax fraud (not sure which) and was made an example of sentenced to 2 years in prison. Anyway 2 years after his sentence finished he received the bill from the DWP which he has been paying back ever since. He is now 63 years old and is still struggling to pay back the debt which has about 20k left. If he were to go bankrupt could this debt be included or not due to the nature of the debt?

speak to DWP, explain your fathers current situation, retirement . lack of work whatever is current and that he can no longer pay back the full amount each month, what amount will they accept
if he has paid back for the last twenty years they may be open to a full and final settlement
