I went BR last September, but didn't include my (or my wifes) mobile phones. They are under a single contract with Orange in my name.
So far there have been no problems, and I have kept up to date with my payments, paying on time every month.
It is now time for handset renewal and I obviouly am worried about upsetting the status quo if I ask for an upgrade. Will they credit check me and see that I am BR?
I think at the moment they are letting my contract run because they simply don't know that I am BR.
Can I ask them for a handset upgrade? They will probably want me to "upgrade" my contract - they always do! And that may involve a credit check.
It's crazy that I should have to worry about this as I been a good customer to them!

Posted - 11 April 2010 : 18:47:15 I think what it comes down to is how much your contract is worth. If it's over £500 then wait until you are discharged, if it's less than £500 it shouldn't be a problem as I don't think you are credit checked for an upgrade.

Posted - 11 April 2010 : 12:37:05 When I upgrade, I take out a brand new contract, which will come with a brand new handset and invariably it is usually a different tariff.
I don't know what happens if you just want to vary the one you have. Perhaps best to ask Orange about that.

Posted - 11 April 2010 : 11:51:33 Ahhh, am I getting confused? New handset is not the same as new contract? But if they change my tarriff is that a new contract?
I assume if it is not a new contract but a variation of an existing one I could do it as the contract was taken out before BR? This is for clarification, I have already decided to wait, but someone else reading this thread would find that info useful.
Orange have a terrible data package and I would love to change, but that's not going to happen this year!

Posted - 11 April 2010 : 10:26:39 If you are already with Orange, they will most likely just check that you are up to date with your payments with them. They won't credit check.
The only time they will do that is if you try and change your company.
Whenever I have upgraded with O2, I have been automatically accepted and not asked any questions about my financial status.

I recently reduced my contracts, wife left last year so I put her contract on minimum, mine I put on my "best price" tarriff which reduced both of them to £25 each. Prior to this they were on £35. The contracts were taken out before before BR, but the changing of the tarriff happened a couple of months ago during BR. All paid up to date.
So my plan was to cancel the wifes contract when it is finished and upgrade mine. Net result is a decrease in outgoings. But if the new contract is £35 a month I can't do it, so better to wait until September when I am (hopefully) discharged and just keep the status quo. If I could get a better handset on a £25 cantract that would be under the limit, but I don't think I would get a better handset on that sized contract these days. I was "persuaded" to get a £35 18 month contract last time so I could get the handset I have now!
When I am discharged will it be a case of checking my credit files before contacting Orange for the upgrade? If they credit check me will they automatically know I am discharged, or will I have to update/check something before I call them?

Posted - 10 April 2010 : 21:38:59 The other thing I've done with mine is to recycle them. There are are quite a lot of companies that do this so it's worth shopping around. The best one I've found at the moment is Simply Drop, which is part of the Royal Mail.

dont think that it is the upgrade that is the problem, I did obtain a nice new phone which my son has taken "too cool for dad to have" ! I am still using a phone that is about 6 years old
I think as Paul said it is the obtaining credit over £500, which could be the problem. I had to sign an court document stating (amongst others) i would not obtain credit and the District judge stated in court about my obligations !
speaking of the £500 credit limit, I received a promtional flyer from a company offering £499 loans especially available to undischarged bankrupts. three months payment free but interest from day 1 over 2400% (think PA not per month) let me think about this!!!!!!!!
Ill watch on ebay for your old phones next time.
Sived you may be entitled to a new phone without an upgrade if you have been a long time customer

Posted - 10 April 2010 : 15:57:49 Whilst not BR, I am in an IVA and have a contract with O2. I have had no problems upgrading at all as they only check how you have been doing with your payments to them.
My contract is over 2 years now, and in 16 months time I shall be on the phone for another upgrade.
I like a new handset!

I think that answer will be when did you take out the phone contracts. you have stated in your first post I already had the phone contracts when i went BR.
when it is time for renew, upgrade or extend the current contract, then you will have to be mindfull of the rules

Thanks for the advice! I'll keep my head down, I forgot about the £500 limit and I strongly suspect they'll be asking me for a minimum of £35 over 18 months, which is a total of £630.
I actualy quite like my handset at the moment anyway!
So what are the rules as I have had my contract (at 2x£25 per month currently) over the course of my bankruptcy. Is that not credit over the limit of £500?
Thinking about it, technically it won't be because I will stop my wifes after this month which I think gets me under the limit again, but if I had kept both contracts going?...

I suggest wait until you are discharged - who needs a fancy phone/handset anyway - I ahve kept mine as it is until May (discharged then)
It does not take much to go over the £500.00 inadvertently!
