Posted - 15 April 2010 : 22:16:12 We both went bankrupt June 2009, I am now discharged husband will be June 2010. Signed IPA papers July 2009 and had copy back saying starts 01 Aug, in the meantime due to health and majpr changes, I left my job and have not worked sinece. We told OR who said IPA was cancelled. Recently receied IPOQ from RTLU and returned showing outgoings are same and enclosed copy of original calculations from OR to prove what had been allowed. The letter said it was looking to recommence IPA which originally started 01 July 2009, we wrote letter saying we understood IPA was cancelled and no payments were made due to me not working so IPA never started, (we had leter saying IPA was stopped). The first payment would have been 01 Aug (not July) but we never nade any. We have now had a reply saying as we signed IPA papers on 06 June 2009 (this was day after bankruptcy order) husband is subject to IPA until 06 June 2012. Could someone please clarify if we are subject to an IPA for 3 years from well dates are very confused but are we subject as no payment had been made and we have letter to say IPA was stopped (told on phone cancelled). We thought that 06 June this year it would all be over but now we are confused. |

stopped is not necessarily the same as cancelled. What normally happens is that they dont ask for payment for he months that the income is lower or nothing, however the IPA remains in force and when income recovers payments resume. The IPA is in force from the moment you sign it not when you make the first payment
Thanks for clarifying that. Looks like it won't all be over for another 2 years but things are getting better. |
