 Hi i have a car with a low value

Hi
This is my first post i am considering going bankrupt albiet not an easy choice but i have an iva with Blair Endersby which is about to fail because i am out of work and can no longer afford the payment of £457pm and recently i have been struggling with health issues. The problem i am have got at the moment is if the OR will take my car off me it is an automatic which i purchased because of problems with my left knee and was finding it difficult to drive a manual car.
I use this car only for my daughters and hospital appts it is also used to care for my ex wife for which i get carers allowance, I have just had an online valuation on the vechile by we buy any car.com and it came back at £370 does anybody think the OR will take the car any advise would be welcome, and sorry for the long winded post.

Hi thanks for that i need the car because i cannot drive a manual car because of problems with my left knee i need the car to look after my ex wife who i get carers allowance for she needs to be taken for doctors apointments the carers allowance covers the running costs of the car so i hope there wont be a problem.

Please be aware that NO car is completely safe!!!.

I was asked what my £500 banger was needed for...so i said `Trips to the hospital`, the O.R then asked, `Is that because of distance to the hospital, or health`....to wich i replied `Health!)...i was allowed to keep the car.

My O.R, even requested proof that i had recently scrapped a car...or they would have it collected??!!l

Don`t assume that your car is automatically safe. Different O.r`s behave in different ways. The `health` issue, will always work!.

Hi David,

I was in a similar situation myself.

I had valued my car on Webuyanycar.com prior to going BR and they valued it at £850. When I went BR the OR said she had valued it via Parkers.com and it was worth £3,000. The problem was that I didn't state the mileage on my SOA form. My car mileage was 240k so it made a big difference to the valuation. I explained this to the OR but because their intial valuation was higher than mine they insisted on sending someone out to value my car in person. Also, as I wasn't working I had to prove I needed the car for travelling to interviews and for work once I found some. This I did by sender them proof of the interviews I had travelled to and that my line of work would require a car.

In the end it all got sorted and I have been allowed to keep my car - it took approx. 7 weeks from going BR to having the car exempt from BR and to receiving confirmation in writing.

Based on my experience I would recommend adding any relevant details concerning the car mileage, condition and why you want to keep it in the "extra information" section at the back of the SOA form. It might just save you a lot of hassle with the OR later on.

As other's have said I don't think you will have an issue keeping the car, but give the OR as much information as possible when you fill in your SOA.

Also when you get your info pack from the OR shortly after going BR, include your car valuation details when you return all of the information they request.
You will then discuss the car when you have your interview with the OR.

As Housing has said, it is extremely unlikely the OR would take the car - for two reasons, firstly you have a good argument that you "need" a car, and secondly, even if the OR decided you don't, it is unlikely he would be interested in selling a car at that value - the costs of collecting and selling it would make it pointless

You should be OK with a car of that value - the OR will establish first that you need a car still I suspect, but the "notional" value is £2K
