Posted - 04 May 2010 : 12:05:09 Hi have been on an iva now coming into the fourth year i have recently had a drastic wage reduction at work nearly £200 a month my iva is 354 a month i really think i am going to struggle to keep the iva going i am considering bankruptcy but have been told as i have an irish passport this wont be allowed i was born in ireland but bought to th uk when i was 2 is this info correct

Posted - 04 May 2010 : 13:16:59 It is really worth talking to your ip as they may be able to help. As you are so close to finishing the iva. They may be able to extend it to give you time or they could have a creditors meeting and perhaps even modify your iva to suit the new circumstances.

Posted - 04 May 2010 : 12:44:38 If you qualified for an IVA ie resident on mainland UK for greater part of last 3 years, you would be able to file for bankruptcy under the same rules - an IVA and bankruptcy are both gpoverend by the Insolvency Act and as suchif you qualify for one you would qualify for the other
