Posted - 10 June 2010 : 09:17:41 hiya to cut a long story short i was in a car accident a few weeks ago!(wasnt my fault)been suffering since, cant work at the mo and my car has been written off! What happens when i get the money for my car? and compensation!?im guessing i have to let them no, will they take my money?also last time i phoned them my file was suitable for early discharge...but havent heard from them since?(will my compensation mean that file will be reopened?) thanks |

If you get the settlement before discharge you have to give up the loss of earnings |

Posted - 10 June 2010 : 09:40:51 yea i was allowed to keep my car when i went bankrupt as it wasnt worth much!so if i get compensation for personal injuries they wont touch this?How can they take my loss of earnings if i need this to pay bills!?(i have no surplus with my wages!) So if i get the settlement before im discharged what happens then? |

Posted - 10 June 2010 : 09:33:42 If the car was exempted then the OR will not take that money, they also will not take any compensation to you for persnal injury, They can take any money for loss of earnings.
Given that the accident was after the bankruptcy order, then you only need to give up the money if the case is settled prior to discharge |
