Posted - 14 June 2010 : 09:11:18 Can you please give me your opinions and experiences today as I am due in court tomorrow.
Debts occurred between 2000-2004/5 97% of debts really just tp rob Peter to pay Paul.....no Aston Martin sitting in the garage!!!
Lived with my partner from 98-01 as was on the small mortgage but as I couldnt pay 'my half' we argued too much and had to go separate ways for a short while.My name no longer on mortgage and briefly moved out.
Couldt find anywhere to live and ended up renting a room in same house and paid rent from then on and was marked as 'tennant'.Amicable solutions and a rare one I realise.
Stuck to a DMP for nearly 5 years and no credit used since approx 04.
House sold in 09 and asked if I wanted to move to new house in new rented room. Still amicable and bigger property.Marked as tennant.
Never been on any land registry and not on mortgage since approx 01 and now facing a re-uniting with partner if I can 'sort my life/finances' out.
My dream: My BR wouldt affect him. My attemt with DMP for years looks favorable as a attemt at least. My ability to live without credit for many years is a plus. Is it still generally true that the OR has very little wants to look further into someones past than the normal 5 years/specially since I never have sold any property etc and have no assets. My car is worth less than £1000.
I feel like I am on the very bottom of the barrell and even though I have all the will in the world to look to the future...I shouldt yet..?!!I am so scared!!

Posted - 14 June 2010 : 16:57:30 i'm sure that your day will go fine, be sure to let us know how you get on. the court day itself is a little bit of an anticlimax because it doesn't sink in straight away that you are debt free.

No its not pathetic.........its just cos you havn't gone thru it yet. I know what you mean about the OR I was like that until I declared then I thought what will be will.
I think at the moment there are soooo many people having to declare bankruptcy that they are so busy and when they come across a straight forward case they just deal with it to get it over and done with.
I didnt even get any forms to fill before my discharge the first I knew about it was when I had letter from OR with a copy of the application to the court stamped to say I had received ED.
I promise you will feel loads better after your hearing and you will be fine if you have an expert helping you as well. I will always be grateful to Paul at Reviva he was a star, everything he said that would happen did except he thought I wouldn't get early discharge til about 9 months and it happened just before 7 months.
Please try not to worry so much, the clerks in court are all very nice and don't make you feel like a you have done something wrong.

My appointment is at 11.00... I too have the advise and help from a BR firm and I continuosly get the advise that the OR shouldnt even care what happened over 5 years ago. I also have been consistently told that because I have tried through DMP for several years and not used credit for many years the OR will look at my case as straight forward.I have also been advised in the very unlikelihood the OR would raise any questions about all those years ago my landlord could fight against any demands as I contributed so little back in those days.
I just have become so paranoid about all this now,that I am convincing myself I will have the worst OR in history with a desire to ruin my life as punishment....and I go over everything in my head again and again and again! Its literally driving me slowly to madness........Isnt it pathetic!

The OR was very professional, non-judgemental. The only reason I needed an interview was because when my ex split up I had to borrow my deposit from his company that he had when we split for my rented house and that was the only reason. He just wanted to confirm/clarify a couple of things. I suppose mine was probably slightly easier because I am on benefits altho he did say that I might get an IPA and I would know within 3 months if I was getting one. He rang me back 10 minutes later to say that he had looked at my figures and there was no way they were able to give me one.
As long as you are honest with them and answer their questions you will be fine. I lived with my ex for 7 years, I hadn't contributed to his mortgage or anything and I wasn't even questioned about it.
What time is your court hearing? I worried about it for 10 years and in reality it was no where near as bad as I had thought.

Hi Karen and thanks for replying. I am a nervous wreck and almost not breathing in anxiousness today. I am not 'worried' about the BR itself-only the part about my name on the mortgage years and years ago. I am so scared the OR is going to look all the way back to 98-01.
What did you speak to the OR about in your interview...and was he/she a nice person..?

I declared my bankruptcy in Brighton County Court in September 2009, I was discharged in April. Like yourself I had no assets, and hadn't used credit for many years. Please do not worry (I know easier said than done). The only contact I had with the OR was arranging my telephone interview and then the interview itself which only lasted 15 minutes.
I know you will be very nervous today I was terrible the day of my hearing, I didn't get to see the judge and fortunately I had Paul Johns from Reviva with me.
I am sure everything will be ok, good luck with your debt free future.

As far as the property is concerned, the OR would usually want a brief summary of what happened and when - if it was originally in joint names but you subsequently transferred your interest to your partner, the OR will want to know when you did this, and how much the equity was at the time - if it's more than five years ago it's unlikely that he will take it any further
As Richard P has said - the main issue here is that you haven't incurred any debt for a long time, and done your best to pay them back
As well as some change for the coffee machine I'd also take something to pass the time that helps you relax (a book, newspaper, etc - I've even seen someone knitting!) as you could be sat around for a while

All my debts were only ever cards and personal loans/overdrafts and only ever in my name only.As said prev-the ususal robbing Peter to pay Paul. I am going to court in East Sussex and have been told by other forum members everyone in East Sussex court system are very understanding and friendly people. I am only worried about the many years ago I actually HAD a link to my partner(98-01).I also couldt remember details about the debt as Its been so long since I have used credit and dared think about all this.
