Posted - 17 June 2010 : 20:52:32 Does any body know if I have to inform the police about my BR, as I have a shotgun licence? Does the OR inform them? I am very worried, as I was made BR yesterday and today I had a voice mail from the licencing dept. Connected? Or co-incidence? It would be nice to know before I speak to them. Many thanks for any advice. |

The poster is one of my clients so just to clear this up:
You don't need to inform the OR that you have a shotgun, unless the shotgun is of value. The Government Insolvency Service have confirmed this.
You don't need to inform the Shotgun icencing department that you have declared bankruptcy. The police chief in the firearms licensing department has confirmed this.
Just thought this might help for other posters.

a shot gun and firearms licence is only allocated to fit and proper persons, although some banks would declare all bankrupts are no longer worthy individuals. Just being bankrupt would not disqualify you from holding a firearm licence.
I would inform the local police firearms licencing department that you have been declared bankrupt, in view of recent events it will show that you are thinking correct. They would understandably want to check that everything is still ok as they have a duty of care to the other residents in your area

Posted - 18 June 2010 : 02:37:40 if it worth not a lot ie under£500 then it is a personal possession that the OR does not need to be specifically informed of as it has no special value, the fact that it is a gun should be irrelevant.

Posted - 17 June 2010 : 21:19:15 dont worry, i can see your reasoning about the value. In this case it is more about the liability to the OR rather than any value. IE if you left the cabinet unlocked and the gun was stolen and used to shoot someone he OR as technically responsible could be in trouble.
Dont worry to much, just ring them up tomorrow, say you didnt realise (after all bankruptcy isnt something you do regularly) and that as soon as it occured to you you let them know at the first opportunity, There shouldn't be any problems |

Posted - 17 June 2010 : 21:16:02 Thanks for that. It really has no value so it didn't occur to me to mention it. As I say, I have not had the interview yet so have not been asked. Now I am scared I have done something very wrong; I thought it would be a relief to be BR but it is worse than ever. |

Posted - 17 June 2010 : 21:07:51 You need to tell the OR straight away, All of your assets vest in the Trustee in bankruptcy. This does not nesesarilly mean you will lose it, If you need it for work it may be exempted or if it is not but not worth much the OR may let you buy it back. But for the moment the OR (or trustee) may be responsible for it and so has to do do all the checks anyone else would. IE check that it is secured and that you hold a valid licence(may check with the police). so speak to them as soon as possible
Being bankrupt should not stop you from holding a licence, it might be more likely that with recent events, the police may just be doing some routine checks |
