Posted - 22 June 2010 : 19:02:24 Well, it will be over soon (i think) My court date is this Thursday at 11.30. It's in Belfast and I am dreading it. They have had all my papers now for a week, what have they been doing in that week? What is the procedure? What will happen to me on Thursday? Will it be in public? Will I cry? what if I do? Will I know the outcome of my property (which thank god is in neg equity - never thought i'd ever think that)
Dreading it but looking forward to it in a strange way!!! help

HI There, I really feel for you but glad to see that all is going as planned, myself and partner went BR in Jan of this year but the judge was less friendly and did exactly what his title says JUDGE, but hey ho we are getting there, You should soon have an appointment with your OR this was a little scary but a nice lady looked at all our finances, I have to pay an IEP of 320.00 per month and am in the process of hopefully keeping my home, if you have no asets though you will fly the interview and walk out with no more money trauma's ope you can sort out your personal probs tho! all the best.]

Posted - 24 June 2010 : 11:06:51 Hi, When you are made bankrupt at court, you are protected from your creditors (i.e. safe).
When you are `Discharged`, it means you are discharged from you debts. Sometimes...when your case is straight forward, the OR asks your creditors if you can be discharged early, (usually after 6 months), if they all agree, or if they do not answer, then you can be discharged. Most of the time, bankruptcy lasts the full 12 months, although the government thinks some people should be able to `Start afresh quickly`, hence ED.
In the period you are bankrupt, certain restrictions apply...I.e, you can`t have credit for more than £500 without telling the lender you are bankrupt, (other restrictions apply).
After you are discharged, you are fully free to receive windfalls, and pay rises without informing the O.R.
Three months after discharge, your name disapears from the insolvency website.
There are many more parts to this....and that would need an expert to say about these.
Basically...its time for you to relax, and start to enjoy life, then discharge time will be here, before you know it!.

What is that period for between going BR and getting discharged. What exactly does early discharge mean? What is the benefits of ED?

the current process across this side is that the local papers do not publish all of the BR petitions, only ones who are of extreme local interest, last year my local rag published about 8 bankruptcies, the local court dealt with 500 petitions, the court is a local small court.
just remember you have not committed a criminal offence in most cases of bankruptcy individuals have lost control of their finances normally due to circumstances beyond their control.
The mental anguish and perhaps remorse that we as petitioners put ourselves through is far greater and worse than what they will do at court.
As long as you have completed your petiton truthfully to the best of your ability, you will find the majority of court and official receiver staff to be helpfull and understanding.
Take a box of tissues and a friend for support and if your emotions flow, so be it

Posted - 23 June 2010 : 10:46:30 Hi Golf88...I was declared bankrupt in Feb `09, and received ED in Aug `09, so i know how much stress comes with bankruptcy.
I also have full blown Crohns....had an emergency op in 2006.
Things WILL get easier for you, I`m very upbeat now, and enjoying life again....even though i`m a medical wreck!

Posted - 23 June 2010 : 07:23:16 I had to hand my papers in a week before being declared BR in Blackpool. I have no idea what they do with the papers (probably nothing) but I didn't have to see a Judge and turned up at my appointed time and just saw a BR Clerk who said I had been declared BR and then gave me the BR certificate. I spent a couple of minutes on the phone talking to the OR's Assistant who confirmed my name/address details, which would be appearing on the Insolvency Website/London Gazette and then walked out of the building 5 minutes later.
I think some courts ask you to hand the papers in the week before so they can get an idea of how many people are turning up to be declared BR so they don't have a backlog. In Blackpool you hand your papers in between Tue and Fri and have your BR appointment the following Monday. When I contacted the court they told me it is best to hand the papers in early in the week (Tue or Wed) if you want to make sure of being declared BR the following week so I think it is just a case of some courts not wanting to be swamped with people and having to send some away. It may also be the case that some courts on have the Judge deal with BR cases on one or two days a week and then they deal with other issues the rest of the week.
Good luck on Thursday and don't worry about crying. Declaring yourself BR is not something to be ashamed of so hold you head high and look forward to starting your new, debt free, financial life. |

I really feel for you. I am in a similar situation, we have decided to go bankrupt and at the moment we are struggling to find the money to pay for the BR fee's.
This is a great website, what I have read here so often is the case that you will feel a huge weight lifted when your are made BR. I myself are so nervous and feel such a failure, which I know shouldn't be the case but then I can't help they way I feel.
I hope it goes well for you, please keep us posted.

I am a complete wreck at the minute. trying to function at work as normal all day as no-one knows (yet-until the Belfast Gazette) it hits me every half hour or so and i wonder how my life turned out like this? How the hell did i let it get here? Beam me up!!!! Sometimes i feel like getting in my crappy wee car and just driving away from it all. I can't even face coming home some days as all we do is fight.... I am kidding myself that once i am BR it will get better cause deep down i know its over. divorce looms and i am a failure in what was my life.
I need this forum now and never ever imagined i would be reliant on people i have never met to keep me going. I feel emptied. My chrones disease is rampant right now and the weight is dropping off before my eyes. People have noticed and it's all i can do not to throw myself on the floor and weep. OMG - get a grip girl.............. thanks.

Posted - 22 June 2010 : 22:23:36 I'll try and answer, but the procedure sounds a bit different from when I went BR.
1. Sorry, I don't know what they would be doing with the paperwork - I handed my paperwork in at court and was made BR the same day.
2. When I went BR (in England) I took my completed forms to court, the clerk went through them, I paid a horrendous sum of money and I then saw the judge. He read through the paperwork, asked me if I'd had advice and then signed the petition. I then had to wait for the BR order to be prepared and I was on my way.
3. No, it won't be public. You may have to see the judge, but not everyone does these days.
4. Don't worry if you cry! I didn't, but I seem to remember having a migraine that night and I cried (make that sobbed loudly!) when the OR phoned me!
5. You won't know the outcome of your property until you have had your interview with the OR. If the property is in negative equity this can be bought from the OR for £1 plus fees.
Good luck for Thursday. It's stressful, but when it was over and done with I felt as though a weight had been lifted off my shoulders x
