Posted - 06 July 2010 : 11:19:35 The taxman refused to accept any payment plan over 12 months ago and wanted full payment or they would issue me for bankruptcy, CAB was dealing with my case. The taxman has now issued me with a bankruptcy notice to be heard in two weeks time and the CAB closed my case as inactive in September 09. I have been making regular agreed monthly payments to all my other creditors but nothing to the tax as I have been waiting for them to issue for the last twelve months.If i live with my wife and have a joint mortgage but no equity will my wife's wages be taken into account as most of her wages is tied up paying for her own monthly credit.

do not expect the taxman to rush things through court , they hope that you will do it yourself and save them the money.
I have a friend who is also in the same position, it has taken 9 months so far, however my friend did sit down with paul@reviva so all the crediors paperwork (answer to petition) is ready to go and all of the leg work has been done so that their is no suprises, when the HMRC eventually turn up with the bit of paper, to say they made you bankrupt last week.

Posted - 06 July 2010 : 13:33:52 If it is only you that is being declared BR then it is only your income that will be taken into account. The OR can ask if your wife contributes to the household costs however cannot force your wife to contribute.
Once you are declared BR all of your debts will be included in the BR and any joint debts will revert to your wife. If you don't have any joint debts then you may as well stop paying your creditors now.
If you want to keep the property and there is no equity in it then you will be able to buy the Beneficial Interest (BI) for £1 + £211 fees.
