Posted - 19 August 2010 : 21:41:05 Hi, if I can get the judgement set aside and an annulment at the same time my investigations so far say that I would revert back to my pre-bankruptcy status. does this mean that my creditors can start proceedings again to recover the alleged debt? the annulment would be on the grounds that the the order shouldn't have been made in the first place - thank you

yes you can get an annulment but it can get complex.
personally I would speak to one of the experts and see if they will help represent you at court, then they can help keep your creditors at bay whilst you plan a method of dealing with any outstanding debts.

Posted - 19 August 2010 : 21:51:12 Yes they can as long as the debt is sound, in fact i have seen cases where the annulment goes through because the petition was not served properly and the creditor attends the annulment hearing and as soon as it is granted serves a new petition
