Posted - 24 August 2010 : 21:41:30 hi. my husband and i have seperated and are now getting a divorce which will be completed in 6 weeks time. while my husband and i were seperated he went bankrupt, we jointly owned a shared ownership property which i am currently staying in. i purchased the share of his from the official reciever which has been completed. but there is still a restriction on the land registry which was added the same day as when the official reciever was put on. the restriction is; No dispostion by a sole proprietor of the registered estate except trust corporation under which capital money arises is to be registered unless authorised by an order of court,. could you explain what this means to me, as i am getting divorced and cant get a mortgage on my own my husband is gonna remain on the mortgage for up to 5 years as part of a consent order which is going through the courts. i would like to know should i get this restriction removed or how can this effect me.
