Posted - 27 August 2010 : 11:21:34 Bit tense today, as Court trip imminent. I see there are mixed opinions about whether to mention the fact that we have a Cashminder account (no cards arrived yet actually)set up for the express purpose of receiving income due and also for paying essential DDs due middle of September. There is about £300 in the account today to cover these payments.
Also, I have a PayPal Topup card with under £1 in, but need this to purchase urgent needed parts for the car and was thinking of paying in some cash at the Post Office so that we can pay via PayPal.
The general advice seems to be that the Cashminder cards/account need not be listed on the SOA, and that the PayPal Topup card is not a bank account and also does not need to be listed (though technically it is a "Cash Dispenser Card". Also, it is advised that we should mention this to the OR (certainly about the Cashminder account), but *when* do you do this - at the Court hearing/filing day,or afterwards when they ring to arrange an interview, or when you are actually interviwed??
We are trying to limit the problems with daily living of course (like not having accounts frozen unnecessarily), not trying to rip anyone off....

As to the question when did you first have trouble paying, what they really mean and would be a better question is "When did you last have the ability to pay all your living expenses, bills and credit repaymnts in a month without it being necessary for you to use any ther credit", that is the point at which you would have been insolvent
What they llok for in your statements is anythig that is unusual, for example large purchases or large cash withdrawals, the are not going to ask about every trip to asda. Also things that dont fit for example if you said that you dont and have never had a car but there are are ots of car related purchases then they would want to know why, the answer may be something as simple as you use your wife's car etc etc. Basically they are testing what you have said in the interview |

Thanks for the reply - no forms have arrived yet, but I expect that is because it is a Bank Holiday week just finishing.
Is it usual that the OR would have received back any requested documents before we are interviewed? Bit worried about this as the interview is only 5 days away.....
Most of our debts have accumulated on credit cards over a number of years, and until about the last 3 months we have always made all payments on time, so I don't know quite how to respond to a question like "when did you begin to have trouble repaying?". It's been difficult for much longer than that but having a number of cards (and with generous and spare credit limits) we always managed to pull through. Taking advantage of balance transfer deals helped until they dried up, combined with others slashing limits and/or raising interest rates.
Anyway, we are going to work through the SOA docs that were submitted for the BR, ready for the interview. At the interview, are we likely to be asked about individual transactions on our bank statements or credit cards, as I understand that they can get copies of these direct from the creditors - if so, how far back should we prepare for this possibility?

Posted - 31 August 2010 : 00:47:50 The forms they send you are quite straight forward. It will include a list of the documents they would like you to send. The form that needs witnessing is the form outlining your obligations as a BR, ie. not obtaining credit over £500 and explaining to any creditor that you are Br and the other obligations that you have. This can be witnessed by anyone, it's just signing the form and sending it back. Nothing to worry about. On the day of the interview have your Br petition and I and E to hand as this is what they will go through with you. Mine asked about each individual debt, when it was obtained, what for, what was the money spent on, when did I begin to have trouble repaying it etc. Basically they go through everything on the form with you. If you are not sure of dates/reasons etc just explain that you can't remember. Mine was fine with that. I think every one of us was nervous about the OR interview but as long as you are open and honest about everything there will be no problem.

Thanks for the advice; the interviews are next week. Which documents should we have at hand?
Also, we were told that they will be writing to us with some papers and we have to sign and return them with a witness signature - I wonder what that is all about? |

Do you know when the phone interview will be? Just a tip -have all your documents at hand and pen & paper. We put the call on speakerphone so we could both ask questions. Some of our I&E was changed (for the better) and I found it helped to write everything down during the phone interview. |

All went exceedingly well on Friday, and now Mrs and I are finally BR. Staff were pleasant and helpful, and so was the OR (over the phone) - all done at the same location.
OR asked what arrangements we had to receive payments and do day-to-day expenses and was happy about the Cashminder a/c (which was not listed on the SOA).
Now we have to get ready for the phone interviews ... |

Posted - 28 August 2010 : 07:07:03 Good luck Searcher - if you speak to the OR directly after the BR order has been made, discuss your accounts. They will not make it any harder than need be and I can't see it any of the accounts you have being a problem. |

Hi thanks for your input - fingers crossed. I'll post an update on how it went at Court once we are back home and recovered (bit lacking on sleep and chilling out time!). |

In my case they also asked about any bank accounts. I hadn't put my Co-op account on the SOA but mentioned it then and there weren't any problems.
