Posted - 27 August 2010 : 22:17:03 We are considering bankruptcy,our house is due a repossession hearing on 22nd october, we wanted it sooner as we havent paid anything at all off the mortgage since may..we were already several months in arrears..the mortgaage company seem to be dragging their heels a bit..we managed to obtain a private rented property in July in anticipation of being repossessed,we move into here on Monday 31st August leaving our current house empty,we are worried though about the OR contacting our landlord if we went bankrupt and how he would react,also what kind of help is available paying any court fees etc for people on low incomes claiming tax credits etc,just seems strange how people who are going bankrupt because they cant afford to pay creditors,then need to find hundreds of pounds to pay fees |

Posted - 29 August 2010 : 14:42:16 You need to open a BR friendly basic bank account, the usual ones that will accept you are either Barclays or Co-op Cashminder account. Co-op is easy to open over the phone, with Barclays I believe you have to go in. You can then arrange for your wages and other income to be paid into there. When you speak to the OR she will ask you what arrangements you have made for a bank account and she or he generally won't freeze this account and will allow it to remain open for your day to day living. All of your other accounts will be frozen so I advise you not to leave any money in there on the day you go BR.

Posted - 28 August 2010 : 09:49:34 If you are on certain benefits you can get a £150 reduction on the BR fee by completing the EX160 form:

The OR normally contact the landlord to check there aren't any arrears on the property. If you move in just before you declare BR then there aren't likely to be arrears so the OR 'probably' won't contact your landlord although there is no guarantee of this. |
