I Have a mortgage of £190000 with my ex partner £ 2000 in arrears at the moment, the repayments have gone up recently to over £1000 per mth which i cannot afford have come to some arrangement with mortgage company, but my partner is unreliable and his earnings have drastically reduced.
i earn about 300 per mth.and live with my new partner and find it very difficult to make ends meet, the house is at the moment being rented and produces £600 a month, all i want is to rid myself of this financial burden and start afresh, can i file for bankrupcy.

Hi Laura, welcome to the forum.

I agree with Big Al, you should take some advice as to your options regarding possible repossession and dealing with your debts. I suggest you give an expert a call from here for an informal chat.

Hi Laura
by the sounds of it, from what you say, all your debts are secured i.e. the mortgage etc, the only debts that can be claimed in bankruptcy are unsecured debts that you are no longer able to service. Therefore the answer is that unless your debts (more than £750) are unsecured , you cannot petition for bankruptcy,however I guess that you do have unsecured liabilities.

However, in relation to the house which it appears you don't live in,you should seek some advice from one of the experts on this forum as to what your best way forward is.
