Ive Just today Completed with some help my Statement of affairs and Bankruptcy petition forms etc.. All ready I believe in all honesty etc ready for putting to court..
My nearest County court that deals with bankruptcy is in Ipswich... The questions I have are :
1) What do i say to them on the phone.. Do i just say im wanting to declare myself bankrupt and have filled in all the forms etc?
2) Im also at this moment in time unable to pay for the whole payment of £600 until i get paid next month.. But should i still call them just to let them know my situation? Even though i dont have the money yet? Would i perhaps be able to book in advance for after i have been paid? Or would it be best to call them once i have the money available?
If you could help atall.. Be much aprriciated..

Posted - 12 October 2010 : 13:27:17 Clive, Once the District Judge has looked at your statement of affairs and declared you bankrupt, that is it, you are bankrupt, no inbetween, and the beginning of a fresh start.
At some courts you can go straight from the court to the OR's office, others you go home and wait for a call from the case clerk, who'll clarify certain things with you, like bank accounts, property, whether you've been self employed etc, then an examiner will call to arrange a telephone interview, which apart from confirming the information on your SOA, is to deal with any assets(regarding cars there is plenty of information on other posts I've made), life policies, and income and expenditure to establish if you qualify for an IPA.
Once that's complete, you shouldn't have too much to do with the OR unless you have property, or qualify for an IPA.

And Big Al I think i know what to expect with the offical reciever.. Ive been told after going through bakruptcy at the court seeing the clerk, pay fees, then see judge.. I will then be either straight after seen by the OR or it will be a phone call after basicly i believe they go through all your outgoings dont they? Just to see if there is still a way of them getting some money paid back to your creditors which i owe money to..
Just wondering though if they cant find any remaining money, Will they then declare me totally bankrupt, fresh start etc??
I know there are other options they can take me through like mothly payment for 3 years.. I guess i will just have to wait and see what happens..
Cant say im looking foward to all this... I know ill be ****ting it the night b4.. Sorry to swear :P lol.. But then again it couldnt get any worse that in has been..

Posted - 12 October 2010 : 11:43:08 Clive, if you need to know anything about the process with the OR, just let me know,I was an insolvency examiner at the Liverpool office, so I can't say for certain what it might be like at the Ipswich OR office, but they all work off the same technical manual,

I've just seen your previous post, and yes, I was in the situation where there was no way I could live and pay my IVA payments. Unfortunately my IP company wasn't very helpful so BR was the only option left.

Booked in for bankruptcy on the 1st of Nov..
Gotta get up proper early which sucks though!! lol Its at 9:00am soi will have to be up for around 7am as have to get the train etc..
Fingers crossed that all goes ok.. Obv im slightly worried about what the outcome will be.. But it has to be done :D
I have photo copied x 3 all paperwork.. Ringing up company who have helped me fill in forms / petition etc tomorrow to go through it all..
So all i gotta do is wait now until the 1st..

And Traceyjr it sounds to me your story is just like mine!! I went through an iva myself.. But the payments were just to much leaving me soo short each month for anything atall..
Anyway.. As said i shall keep you all updated :D

For years all of my salary went to paying off my debts until it got to the point where I couldn't cover the repayments. I then tried an IVA, but that failed so my only realistic option was BR. That gave me the fresh start, and although it was very stressful it was worth it in the long run.
You will get there, so don't give up x

It will all be alright i guess.. Its just been years of struggling now and its just the same old each month.. :(
Just have to wait until next month now.. love working my arse off to pay of debts "not" :( :@
Maybe it might be a new / fresh start for next year?!

Posted - 04 October 2010 : 12:47:21 Ok.. Just called the county court to book an appointment.. The latest they could have done was the 28th Oct.. The date i normally get paid! But with my work its not always gauranteed! Soo anyyoingly i will have to just wait until i get paid again.. Then i will book an appointment.. I'm Soo stressed atm.. Ive been depressed for soo long now because of it.. Constantly feel tired.. just generally fed up!! and i worry sometimes if im able to keep control over it all.. To keep myself sane.. :( Nest thing ill loose my job through illness..
I Just want out of debt, Its the worst thing ever in my eyes.. Just feel i can move on.. Until i sort my own life out 1st.. And i feel for all of you in the same situation..
But we will finally get there hey?

If you are sure you are going to have the money available for the appointment then go ahead and make the appt.
When you phone up all you need to do is to ask for the bankruptcy clerk and ask for available appointments for a Debtors Petition.
They may ask if you have your fee and have you completed your forms.
If you say you haven't got your fee together yet they are likely to ask you to call back later..
If you say you have your fee then you can make a booking
