My mobile phone contract is due up for renewal tomorrow and before do anything I just wondering if anyone can help by answering the follow:-
1) I didn't owe Orange any money as part of my BR and have always paid by DD on time. Do I have to tell them once renewing my contract that I am currently BR? (in there terms and conditions it states they will cancel any contract should they find out about BR proceedings)
2) I'm not after altering my contract or my monthly payment any - all I need is a slighter newer phone and to contnue to pay aprrox £25.00 per month. Do I have to inform the OR if my contract amount alters any either more or less per month?
The OR excepted my monthly amount when going through my Ingoings and Outgoings and as yet I haven't been told about any IPO that I may have. (telephone interview was in August 2010)
I have visions of ringing up tomorrow and them doing a credit check on me and my contract getting cancelled?
Does anyone have an idea of what Orange are like to deal with?
Should I just keep quiet and maybe purchase a phone off Ebay??

Posted - 12 October 2010 : 23:57:19 Carl, having been informed by the examiner that you don't have sufficient surplus income for an IPA, you generally won't get that confirmed in writing. But if you are recommended for early discharge, you will be sent a form known as an IPOQ to fill in, which is basically an income and expenditure form. If your circumstances haven't changed, you'll eventually be dischgarged early, with no IPA.
Fortunately I was working tonight so I didn't suffer the pain of watching England!

Posted - 12 October 2010 : 22:21:16 Sadly I wasted an evening watching England! I wish I'd gone down the road and watched my local team in the FA Cup - at least they won! I decided to save a tenner though!
I don't blame you, any surplus is yours to do as you want - just bear in mind the £500 limit.

I've been thinking along the same lines myself with regards to the phone contract of just doing it and if it is picked up at a later date, I'm sure I will be able to justify an increase of £10.00 per month (well hopefully) I've always got my surplus if I get an IPA.

I wouldn't class car insurance the same as a phone contract - if you stop paying your car insurance your insurer will cancel the insurance, whereas if you don't pay your phone contract you're liable for the whole contract.

Posted - 12 October 2010 : 20:36:26 To be honest I never thought of the phone contract and credit like that - i.e the monthly amount x 18months (lenght of the contract) might take me over the £500.00 limit. (I'm thinking that my Car Insurance is due in January 2010 and I bet thats over £500.00!!)
I'm in abit of a pickle of what to do next really.
Should I contact the OR to discuss it or should I just upgrade and wait to see if I am subject to an IPA. During my OR telephone interview she that that I did not have the disposable income for an IPA but I haven't received anything from them confirming this as yet (2 months later)
I know there is no way I could swap to another provider trying to get costs down with my credit score being so low and I was hoping to keep my contract running once I have been discharged as a way to try and improve my overall credit score. |

Posted - 12 October 2010 : 18:54:46 I seem to remember someone saying that you have to check the cost of the entire contract and if it's over £500 it's a problem - you cannot take credit for over £500 without notifying the creditor that you are BR.
e.g An 18 month contract at £35 per month would take you over the £500, whereas an 18 month contract at £27.50 would be fine.

Posted - 12 October 2010 : 18:13:16 You can always ask the OR for a £10 allowance in the mobile phone and if they say 'no' you can just pay the extra out of any additional income left over after your IPA and other expenses have been paid. |

I've contacted Orange and as everyone as said there is no problem me upgrading my phone and renewing my contract. There was no mention of BR by the chap at Orange.
The only issue I have found is that my current contract is approx £25.00 per month (which OR allowed) but Orange have offered me two options:-
1)To keep the same amount of mins and text and have a 'normal' upgraded phone has incresed to £27.50 per month (£2.50 increase)
or
2) Same amount of mins and text but get an I phone and that contract is £35.00 per month.
Now I don't want to get the I phone upgrade if this may cause me some probelsm with the OR at a later date if for example they review my Income and Expenditure. I think a £2.50 increase is reasonable but would it be frowned upon if I went for the I phone which would mean an extra £10.00 per month? |

Posted - 12 October 2010 : 11:21:51 Carl, As long as your direct debit payments are up to date on bankruptcy, any amount due on the contract isn't claimed in bankruptcy, as it's part of the contract.
I was never aware of mobile phone companies checking the London Gazette, to see if their customers are bankrupt, the only way they would find out would be if you declared the amount on your statement of affairs, resulting in a report to creditors being issued to them, but as previously stated, you don't need to declare it in the SOA.
I presume that with a new contract, it won't entail credit of more than £500, so you don't need to tell them.

Posted - 12 October 2010 : 10:49:01 If you tell them they will definately cancel the contract and you will lose your number. they will not allow you to retain it and will not give you the pac code.
you will then be unable to get a new contract for 2 - 3 years so will go onto pay as you go which means higher phone bills

Posted - 12 October 2010 : 09:45:28 I was the same with T-mobile. Me and my husband have been with them for a few years and my husband took out a new contract with new phone while bankrupt and we had no credit checks. we are now discharge. |

Posted - 11 October 2010 : 18:49:02 I think Vodafone had the same clause but as I didn't owe them money I hadn't declared the contract so they never found out. I upgraded my phone while I was BR without any problems.
Obviously that's only my experience so don't take it as gospel!

Posted - 11 October 2010 : 17:16:11 But if it says they will cancel any conract if you are BR it might be best to tell then asa new contract won't fall under BR proceedings & you could technically owe them money for nothing. |

your annual agreement falls below the "£500 requirement for you to tell creditors" and I suspect that they will not do a credit check as you are already a valued member.
