Posted - 29 October 2010 : 14:12:01 me and my husband are filing for bankruptcy but our debts are in seperate names. It may be a daft question but how does it work with the court and the OR as we have to file seperately but our expenses etc are joint. My husband has more debt than me so what do i put on the forms as the debts on mine are different to his?? should i put a note on the form of this. |

Posted - 03 November 2010 : 11:47:17 Hi ddonna
on the bankruptcy form their is a section to put cars you have access too but do not own. I agree with Chester in relation to the car and current work arrangements
If you have entered the car, then you can claim some of the running costs in your income and expenditure.
your plans for the future will dictate the best way to complete the I & E.
never straight forward and always best to take advice if it gets too complex!

Posted - 30 October 2010 : 15:04:25 Hi its worth £800-850 and has an odd side wing!!!My husband works so it'll go on his form ,thanks for the advice Donnaquote: Originally posted by chester2005
ddonna do you both work? if you do it doesn't matter whose forms the car goes on. if only one of you work then put the car as an asset on that form and on the other form tick the box that says do you have the use of a car not belonging to you. how much is the car worth? if over £2000 the OR will want to take it.

Don't worry or know that worrying is as effective as trying to solve an algebra equation by chewing bubble gum.(Baz Lurhman) RevivaUK and Paul Johns helped me through it all i can't recommend them enough!!

Posted - 29 October 2010 : 15:01:48 Thankyou,it all sounds kind of straight forward.our car is registered in my husbands name (we own it outright) so should i just put in on his form or on both ??quote: Originally posted by chester2005
you file your papers separately see the judge separately (sometimes not) list on the forms you're own debts and any joint ones list on the forms total household income and expenditure and your contribution to it.
