Posted - 29 November 2010 : 17:17:00 dear bankruptcy help team, I have debts of 27500£ as i suffer from severe depression and was trying to make ends meet by paying bills using credit cards. I applied for IVA in may 2009 and an IVA was set up in june 2009. However, it failed after 2 months as i fell sick again and lost my job.NHS refused to offer me psychotherapy so i decided to go to Pakistan where my parents live to seek appropriate treatment. I paid the company (beesley and co) to file for bankruptcy on my behalf but that was struck out. I was tols that if you are not in the country (uk)courts will not declare you bankrupt. I am now planning to return to uk but i have a concern that my creditors may have contacted the police and i may get arrested on arrival. Can you please let me know if this is a possibility and how can i avoid it. I am planing to return to uk soon to declare voluntary insolvency. regards waqas afzal

Many thanks for your reply. I have tried to access the insolvency register online but was unable to as it is not currently available online. Is there another way of accessing the register available?
regards

Posted - 29 November 2010 : 17:33:20 I would advise you to contact Paul Johns at Reviva (see experts link on left hand side) he helps a lot of people file for bankruptcy whilst out of the UK - as such he would be the best one for you to speak to.
As for your creditors, your creditors would not have reported you to the police as debt is not a Civil matter, therefore you are not liekly to face arrest (unless of course you have committed fraud - as this is the only time police would be involved) Your creditors may have petitioned for your bankruptcy (you can check this on the Insolvency Service Register, as it would recorded there if you had been made bankrupt)
Hope this helps
Melanie
