Hi,
My partner and I went BR in March 2010. I do not work but I get tax credits and working tax credits. My partner is self employed. In April this year my partner was in a deficit, we had a rebate, but needed to use it to buy a work vehicle, when we got the money again to pay the OR we had to spend this also as my partner has been out of work for a few weeks. We have not mentioned this to the OR as we hope to get the money again and then pay her the full amount. Is this wrong of us? We will also be in a deficit this year as it has been just as bad.Family members have paid our mortgage and secured loan for us. Also the work vehicle was reposessed just after our BR, they have decided to charge us money for apparent repairs will this be added to our BR? We have sent them a copy of our BR, will this clarify the situation at all? Also as we have been BR for almost nine months, what is the chance of an IPA? We really do live hand to mouth, sometimes we have money and others we have nothing.

The van was included in the bankruptcy, but was reposessed after BR. I will contact our OR about the tax rebate and explain what has happened.

Dear Rayvn

The OR is not an ogre and you must communicate with her. I am assuming from the first part of your message that the tax rebate was going to be paid to the OR but you have been unable to due to your partner being out of work. I reiterate, you must tell the OR of your situation as she will be starting to think that you are not co-operating with her which could end up with the situation becoming considerably worse.

If you purchased the works van after you declared yourselves bankrupt, any charges arising will be your responsibility and can not be included in the bankruptcy. However as it is not clear when the vehicle was bought, it could be included in the bankruptcy along with any related creditors if it was bought and the charges were incurred prior to bankruptcy.

On the plus side, I think that it is highly unlikely that you will get an IPA especially as it sounds as if you do not have any disposable income.
