Posted - 13 December 2010 : 20:31:54 Hi All I have a question about my IPA which was set up in Dec 2007. I was issued with an IPA for £59 per month which I signed for without understanding it. I made the first payment then appealed in writing to the OR in writing making no further payments. This was in Jan 2008, I have today received a letter requesting info on my earning so a new assessment can be made.
When I questioned why it had taken so long for them to review my case they could not provide a reason. They also said "After the thirty six months, should the file be in default, the Official Receiver can contact you to seek voluntary payments to clear the outstanding balance."
I am really worried about this now, they where incompitent and to be honest I have been too scared to contact them.
Where do I stand with this?

I have already responded by email giving them basic details and have had a reply.
The person I am emailing seems to be avoiding the question about the payments being voluntary. I am waiting for an assessment tomorrow to see what they are asking for.
I will challenge the Insolvency Service at that point if need be

Posted - 14 December 2010 : 09:48:27 At that time it was Wilmott Clarke collecting the repayments rather than MoonBeever but as debtinfo says check if the repayments are voluntary.
Ignoring them isn't a good idea so send them a letter saying exactly what happened (i.e. signed the IPA and made one payment before you were aware of the situation and then appealed) and say you are not willing to make any voluntary repayments and see what happens. I wouldn't complete an I&E until you are forced to.
Make sure you send any correspondence Recorded Delivery so you have proof that you have responded to the Insolvency Service and haven't just ignored them. |

Thanks for the reply.
The letter I got was from the Insolvency Service.
I never received any response to my letter in 2008. I did phone and speak to both the company collecting the payment (dont know who they were) and the person dealing with my case before sending the letter.
Dont know were I stand now or how I am going to afford the payments they come up with

Posted - 14 December 2010 : 09:12:47 When you appealed against the IPA in Jan 2008 did you receive anything in writing from the OR saying that they had accepted your appeal? If so, you can forward this letter to them.
Chances are that if you made your only payment in Dec 2007 and nothing since then the OR was happy that you shouldn't have had an IPA and accepted your appeal.
Also is this letter from the OR or from MoonBeevers who are the firm the OR uses to collect the IPA? |
