Posted - 10 January 2011 : 01:27:05 90 day sale valuations - How acceptable are they by the OR or Trustee?
Further to my question on 7th Jan 'Being taken to court for possession order'.
I have seen several pieces of advice within the forum whereby a quick sale valuation or 90 day sale valuation has been suggested. Do you think obtaining one of these would help my situation or is the Trustee likely to ignore it? If case goes to court will it have any weight with the judge? I have arranged one with local agent but don't want to rock the boat but then I have nothing to lose at this stage by submitting it as it looks as tho' odds are stacked against me anyway.

Posted - 10 January 2011 : 14:35:42 Thanks I guess this stands to reason, I can only but try as obviously Trustees costs are escalating too so less for creditors. I will update you!

Posted - 10 January 2011 : 14:24:15 The ball does tend to be in the trustees court tbh but the nearer you get to their figure the more likely they will be to settle out of court.

Posted - 10 January 2011 : 14:00:34 Thanks, I will at least have it to hand if needed at later date. Still awaiting Trustees reply to whether open to further negotiation and settling out of court, I may able to raise bit more (looking into this) but even then still 20% off required amount in full. If they refuse then I need to decide to whether to even go to court and possibly end up with costs if I lose or just hand the keys back. Part of me wants to see it thru and state my case and see what the judge's view is on my offer. Or is it merely a forgone conclusion based on Trustees entitlement.
