Posted - 24 January 2011 : 17:58:54 Hi, I am on the other side of the fence - being a creditor (an individual) to a company who has gone bankrupt. I was seeking judgement but other creditors got in before I did and got the judgement and petitioned for the bankrupcy. What do I do next, as an official receiver has been put in place? Do I still need to get judgement and/or how do I know if I am on the list of creditors in line for a payout (if any)?

the official receiver will write to all creditors asking for proof of debt but this can take 8-12 weeks.
if you have details of the OR you can write to them and ask for confirmation that your debt has been included in petition.
If there is any funds or assets within the bankruptcy estate than at some stage in the bankruptcy a creditors meeting will be held may be as long as 6 - 9 months from court date and what is left after trustees and secretary of state has been paid is shared between creditors.
