Posted - 27 January 2011 : 08:23:59 I have been sacked from my job. I have been overpaid housing benefit, council tax benefit and incapacity benefit to a combined total of approx. £25,000. I am now in receipt of jobseekers allowance. Can I declare myself bankrupt?

To answer your question, the council wants payment in full(which I don't have) otherwise they said they will take it to court to make me pay. And the DWP have not informed me of their intentions yet. I think they are wandering if its worth taking me to court or not as I am staying with friends and registered no fixed abode.

Also £25,000 is a lot to be overpaid, are the relevant departments looking at any criminal investigations out of this?
