I borrowed 24k from a family friend in 2003 and signed a promissory note through solicitors to pay back £500 a month for 60 months. Various circumstances over this time meant I couldn't afford to pay £500 each month so now he has applied to court for ccj against me. I went to court last Tuesday to go bankrupt. What happens now with the debt to him? Can he still take me to court or does the bankruptcy order protect me? He said he will tell the newspapers and local tv about me owing him money. He has already wrote to my family members about me. Does anyone know? I am worked sick.

As the others have posted, welcome to the forum & remember we are all here due to many different circumstances. No one here will judge but everyone will want to support anyone who is going through, or has been through, this stressful time.
Post here as often or as much as you need. We need each other for guidance and help at many times. I have found all advice on here to be sound & honest.
Aren't we lucky to have this site.

I agree with the others. He cannot sue you and even though he may have written to family members that's the worst he'll be able to do.

The papers and tv won't be interested at all.

Thank you so much for the reassurance.

I've struggled with debt for 11 years now, robbing Peter to pay Paul, and pretending to all that life is great!

After many months of research, I decided now was the time to apply for bankruptcy rather than burying my head in the sand, and this forum has been a god-send.

Debt feels such a lonely problem. I can't remember the last time I had a decent nights sleep! But this forum has made me realise that there are many others going through what I have and there is no need to feel lonely or a failure.

Hi,

Do not worry, the debt will (from what you have described) be included in your BR - speak to the OR staff member that is dealing and she/he will assist.

He cannot "sue" you... The debt will be captured in the BR and "lost"

Be positive and do not let him intimidate you - if he does, tell the OR - that is a criminal offence and can be dealt with if he tries to do anything untoward. He is not allowed to do anything such as you are fearing - Richard

Hi Jo and welcome to the forum.

I doubt that any television chanel or newspaper would be interested in his story, sounds like he's just trying to threaten you.

I presume he was listed on your SOA, the official receiver will contact him and his debt will be written off in your bankruptcy
