Posted - 31 January 2011 : 04:49:23 I was declared bankrupt in November 2008 and discharged in November 2009. I had a car on HP. When I was declared bankrupt in 2008 the Official Receiver allowed me to keep the car and instructed me to get the Finance Company to contact him and then I was to negotiate with them for the agreement to be re-written at a much lower monthly payment. I wrote to the Finance Company with these facts but they chose not to contact the Official Receiver and never made any further contact with me. That is now 2 years and 2 months with no contact but the debt still shows on my Credit Agency file which I am trying to clean up. If the Finance Company decide to contact me now what are my rights regarding the car and the debt. |

Posted - 31 January 2011 : 16:14:22 I'm nit sure if it would be covered by the bankruptcy or not. Maybe you could try ringing the OR's office who dealt with your bankruptcy & find out. How much is the care worth now & how much do you need to pay on it? |

Posted - 31 January 2011 : 15:09:21 They received the letter because I discussed it with them on the phone. Never paid the reduced payments as they never agreed a reduced payment. Nothing has been paid since Nov 2008.
