If I live overseas and I am EU national but not a UK passport holder, how can I file for bankruptcy? I need to file bankruptcy for a house that I own in the UK....

I don't believe that the US Br will cover UK debts

Hi Paul

debt info is correct in stating that the three year rule is quite strictly enforced.

obviously the debt is UK based but USA would be classed as the centre of your main interest.

if you do not want to petition for your own bankruptcy you can apply for some else to undertake a lasting power of attorney and deal with your bankruptcy and UK estate

I do not know if all of the experts are able to assist with LPA, I am aware that Paul Johns at Reviva is very knowledgable for LPA and he may be worth an email.

yes you could petition in the US and the US and UK usually uphold each others orders so in effect it should sort out all your debts

Thanks debtinfo for the information.
I am currently employed in the US. Could I file for BR over in the US then? And would it be recognized in the UK?
I have some issues with the propetry I own in the UK amongst them a negative equity...I have tried selling but it seems impossible in the current market and it is getting harder for me to manage from overseas. So as a last resort, I am considering handing back the keys to the bank and file for BR. The other option would be to return living in the UK...but I would have to resign from my current job and go back to the UK without a job, etc...another problem. I don;t know what to do and am just trying to see what options are there.

If you have been resident in the US for more than 3 years then you may not be abe to go bankrupt in the UK, do you work or trade over there
