Posted - 15 February 2011 : 10:28:12 Hello, My ex is going to declare bankruptcy and I am worried that my home is going to be at risk.
We split 5 years ago and I remained in our home with the kids, he moved out. He carried on paying the mortgage to help out but he told me he couldn't afford it last year, so I sold the house last year and kept all of the equity (£50k) as he said that was only fair as I had the kids. I then bought my own place for me and the kids, using that money, mortgage and family help.
Can the court take my home? We didn't do anything through a solicitor and we're not divorced? Thanks |

Posted - 15 February 2011 : 20:43:26 If he was insolvent at the time he gifted the equity then it is very likely that this could happen so we would be talking about 25,000 pounds. |

Posted - 15 February 2011 : 18:53:06 It is likely that the trustee will ask for at least part of the money back |
