Hello, My ex is going to declare bankruptcy and I am worried that my home is going to be at risk.

We split 5 years ago and I remained in our home with the kids, he moved out. He carried on paying the mortgage to help out but he told me he couldn't afford it last year, so I sold the house last year and kept all of the equity (£50k) as he said that was only fair as I had the kids. I then bought my own place for me and the kids, using that money, mortgage and family help.

Can the court take my home? We didn't do anything through a solicitor and we're not divorced? Thanks

no, as transactions can be overturned for 5 years

He was insolvent. Would it make a difference if we divorced before the bankruptcy?

If he was insolvent at the time he gifted the equity then it is very likely that this could happen so we would be talking about 25,000 pounds.

It is likely that the trustee will ask for at least part of the money back
