Posted - 27 February 2011 : 22:12:50 My husband moved out of our family home which is in joint names Sept. 2009, and we should have been divorced later this year. He declared himself bankrupt October 2010 but did not inform me or our solicitors till January 2011. Despite a struggle, the house is on the market, I have continued to pay the mortgage and house insurance myself. During the cold spell last December we had a major flood with extensive damage to building and contents and subsequently I had to move myself and the children into temporary accommodation. This was the last straw for me and so I decided to take on a firm of Insurance Assessors to deal with the claim for me.
I thought things couldn’t get worse however, because his name is on all the insurance paperwork I have been told I can only progress if he agrees to remove himself from the policy. True to form he is refusing unless I give him cash (blackmail in other words). Do I have any legal rights, if not how am I ever going to resolve this please?

with ex going BR it may make it easier for the situation to be resolved.
in BR the official receiver takes over an individuals estate and you should be able to communicate direct adn hopefully resolve quicker
