Posted - 01 March 2011 : 18:15:57 Hi all, a family member of mine is going bankrupt tommorrow and i was just wondering is there any reason that court would refuse to declare her bankrupt. She is a little worried that for some reason it will not be allowed and she will have to catch up on all missed payments. (she only stopped paying them this month. She has completed all the forms and made an appointment at the court.

Some reasons could be Se is petitioning in the wrong court juristiction she does not have the correct fee The forms are grossly incorectly filled out Se is not actually insolvent She is abusing the process to avoid another action for instance sometimes with divorce
And very rarely the judge believes that an IVA would be more appropriate
These are all exceptional cases, most people are fine
