Hi I have recently separated from my husband he is keeping the house with a mortgage of £148000 house is worth £165000 and he has one credit card for £6700 mortgage payments of £890 per month and £100 on credit card. His annual income is £38000 he is saying he is going to go bankrupt as he can't afford the payments we are in the early stages of getting my name of the mortgage i am in a rented house he is saying if he goes bankrupt it will force me to go bankrupt and i will lose my rented house and will have to make the mortgage payments is this right ? We also have 2 children togeather so he is paying me £80 maintanence a week

What an awful situation for you to be in.
As Housing has said, post back some more details & The Experts will do what they can to assist.

If you have a joint mortgage then it will fall to you to pay the shortfall if the house is repossesed.

Could you make the mortgage payments if you move back into the house instead of renting?

Hello Angela,

Welcome to the forum.

I assume the house is in joint names?

What about the revolving credit - is that is his sole name or joint?

Are there any other joint debts?

You said you are renting a property - is this with a letting agent or the local council or a housing association?

It is not a certainty that you would lose your home so do not worry on that score - I have lots of ways for you to consider and for the council to assist you with potentially

Can I suggest that you post back a bit more detail and we shall see where we can go...
