Hello all

Not been on here for while and I hope everyone is well.

I received the following e mail today from the case clark who dealt with my BR case at the Blackpool office.

"Dear .........

Due to the reduction in staff we have had to suspend the Early Discharge procedure. If you have a change in circumstance such as a change in job, a pay rise or you move house or change your contact details you have to inform our stoke office where your file is now held.

Your property will be reviewed around 2 ½ years into the bankruptcy and they will contact you at this stage. Other than that you will get automatic discharge after 1 year and you will not receive any paperwork regarding this.
Regards"

I had been told from day one that my case was straight forward and that I would be recommended for early discharge but it looks like the office that has dealt with my case has got caught up with all these Government Cuts backs.

My question is regarding the last sentence in the e mail they have sent to me. Have I read it right in that I will not receive any further paperwork from the OR and its just a count down for my AD date? I thought that the OR reviewed your income at stages of BR to check there hasn't been any changes?

I have just finished paying my NT IPA.

Im not far off AD (6/7weeks)and havn't had one, not working and pay no IPA, there seems to be evidence on this and other forums that it is not happening to everyone

Hi,
The only time when one wouldn't be sent out in all liklihood, is if you were long term unemployed through sickness/disability with no probability of your situation improving and all your income was benefits, then an IPOQ shouldn't be sent out.

Otherwise, with ED going and new procedures in place since December, the OR will send out an IPOQ about 6 weeks before AD just incase your finances have improved. But don't delay sending it back thinking that by doing so it won't give them time to set up an IPA, as the OR could apply for a SOD(Suspension of discharge) to allow it to be dealt with.

I think everyone gets one now whether they are paying an IPA or not.

Last IPA payment made on 28th June 2010 - it's over at last!

Does EVERYBODY get an IPOQ - I have heard some do not,depends if actually paying an IPA? I'm currently unemployed as well

Hi Carl,
the ED procedure was being reviewed while I was with the IS, so especially with the cull of staff as well, it's a surprise it didn't go earlier.
So you will get an IPOQ about 6 weeks before AD, then at the 12 month point you will be automatically discharged, no letter or other notification.

LI was under the impression that my income would be reviewed at the six month stage but I'm guessing that was for an possible early discharge. I only have four months to go before A.D anyway. I also thought that they would try and review as many cases as they could with the new lower IPA limits before AD to try and get as many IPA's up and running as possible especially since my BR date was before the changes took place

AD is exactly as it says - you won't get any communication as the BR will drop off after the twelve months unless there are any complications.

This is consistent with a similar situation in the Birmingham area. A friend who went BR in January 2010 and had no IPA/IPO was automatically discharged with no communication from OR. I have around 3 months to go….have no IPA/IPO…..and besides the first interview with the OR over the phone have heard nothing from them.

I think it makes it clear that if you have a pay rise, move job, inherit money etc etc you have to inform them otherwise not.
