 IPA - what if you can't afford it?

Hi,

Please could you give me some advice? I went BR at the end of March and had my call with the OR today.

I put together a new SOA yesterday as the company who did mine for me picked numbers out of thin air and it was a bit of a mess. Anyway, I put the figures in based on what actual outgoings. I worked out that I will have about £2 disposable income.

When I spoke to the OR she said she would write to me with a suggestion of what I should pay for my IPA and said i could suggest what I think I can pay. She said it should be a figure i am comfortable with but its tight as it is, i don't know how i can make a payments i'm comfortable with. It's not that I think all the debt should be written off and I shouldn't pay anything - if I had it, I would pay it.

However I really can't see what I can spend less on as some of the figures are fixed (gas / elec / water etc).

One of the problems is my cats - I have two who are insured and sick so need special cat foods otherwise they throw up and have diahorrea. Can the OR make me spend less on the cats or make me get rid of them? I already change the cat litter less and feed them less so I spend less. And I know that sounds cruel.

What do you do when you really think you cannot shave money off?

How much do you guys put in for your hair / entertainment / holidays / presents?

I have put nothing in for entertainment but have for the others.

Your advice would be appreciated.

Ours have cast iron stomachs as well and will tolerate anything. At the moment it's Butchers with Chappie dry food with some home made gravy and scraps depending upon what we had the night before!

Not that they're spoiled at all!

Funny thing is that when our previous dog was ill, the vet described chicken and rice which is usually very good - she loved it but then promptly threw it all back up again, for some reason it didn't agree with her!

When we got Harry we started him off on Sainsburys own brand tinned food and when he went off that we tried him on Felix (never again, it didn't agree with him!), and then it was Whiskas, and now James Wellbeloved dry food. He's choosy about the flavour as well - duck only, although we do try him on turkey now and then!

When he was ill last year the vet prescribed a bag of special food and Harry looked at me as though I was trying to poison him!

Mine aren't fussy, they would eat anything they could get their paws on if they had their way.

They just throw up if they eat anyting other than the stuff the vet recommended which is very gentle on their stomachs.

The worst thing is they hate the stuff. They stand there looking at me when I feed them as if to say 'what's this muck? where's the whiskas?'

I couldn't get rid of them even thought I'm tempted at times (like when they jump on me in the middle of the night). I think rehoming them is just cruel to them especially now they are 8 and 9 and too used to me.

I also don't know how I can cut down their expenses - I've got to get proof of their costs which is easy to do. Will the OR accept that they need cat litter which is £15 a bag?

No, they won't give you a BRO if you end up going to court, but hopefully it won't come to this anyway.

On the subject of cats I know what you mean about the price of cat food! My little diva refuses to eat cheap cat food and it costs £13 a bag and that's not prescription! Oh and he will only use Catsan cat litter...

They are worth it though aren't they?

Thank you guys.

I will def send them proof for the cats - receipts from the online vet place where i buy the litter / food. The or told me not to contact the vet and ask for a letter etc as she didnt want me to incur any costs which is good. Believe me, I wish I could buy £2 cat food rather than spend £18 a bag :( (It's prescription food).

I can of course provide them with proof of all the other things and argue why I need them / they are justified. But what if they still insist I make a payment and I don't think I can? Is it bad to go to court? Will they slap me with a bro for being difficult? I don't mean to be difficult at all :(

As stated - it is all down to an individual basis and should be discussed with the OR.

This is an extract from the IS guidance manual…

Other general household expenditure such as hairdressing, family holidays and additional allowances for pet expenses: food, insurance etc. should be considered on an individual basis. No amounts should be included for these types of expenditure where it cannot be evidenced that the expenditure is fulfilling a reasonable domestic need given the particular circumstances of the bankrupt and his/her family. Where any household/family expenditure claimed appears above average or excessive, further explanation and evidence should be sought. Where no evidence is provided to the official receiver to justify the excess expenditure, he/she should either disallow the expenditure or, where appropriate, include a reduced amount for that item, referring to the average expenditure guidance for a similar sized family unit in the HES.

Its up to you to prove to the OR that your needs are reasonable…perhaps a letter from the vet would help. You do not have to agree to an IPA. If you and the OR cannot reach an agreement on an IPA it will go to court and if the OR is successful an IPO will be given. You have nothing to lose at this stage fighting your corner.

hi im not an expert but im going br end of april its only me and my daughter who is in full time education ive put 20pound for hair nothing for entertainment but you can have 10pound each for emergancy ive put 20pound down for my dogs an expert will be along soon to help hope you will be ok
