Posted - 26 April 2011 : 12:39:48 Hi,
I was declared in March '11, an IPA has been agreed, I am just awaiting 'Moonbeaver'. As it stands there is the very real threat of redundancy in my work. If I were to accept Voluntary Severence (afore Compulsory is imposed), how would that be viewed by the OR in respect of monies received?
In essence, will the OR have any interest in the money received, be it received through Voluntary or Compulsory Redundacy?

debtinfo, many thanks for the prompt response. Can I just clarify: Irrespective of whether I 'take' Voluntary Severance or it is Compulsory and 'imposed', the OR can take any monies given? If so, what would I be expected to live upon?
I was in the same position as you recently - I was made redundant and was worried about my redundancy payment. It was a compensatory payment for them making me redundant and treating me badly and should have been my salary for several months. I didn't get why I had to lose it all. As you said, what would I live on? Afterall, benefits are really rubbish, why should I go without the basics and stress about things like paying utility bills and getting the car insured and MOT'd because I had to pass the money to the OR. Surely it would be more fair to live off it as a salary and then to pass whatever was left to the OR after you had found a job? I face being made redundant again in the coming months and fear that any payment I get which should be used for living costs will be taken.
If I don't get made redundant, we will be moving offices and I'll receive a lump sum towards the running of my car / extra petrol costs. The OR will probably take this too - how will I be expected to pay for my petrol when they take the money that this is for?
They just make me so mad. I am not trying to be dodgy or get something for free or pull a fast one, but I think they are very unfair sometimes. I think I wouldn't feel this way if anything the OR received wasn't going to make the banks even richer and allow them to pay out bigger bonuses.
Finally got head out of sand in October 2010 BR March 2011

Posted - 24 May 2011 : 18:53:58 Still early days for us. IVA has been unsubstainable and we are awaiting creditors decision re failure. The option at work is for voluntary redundancy, so I think I will not look at that option for now. Thanks |

Posted - 24 May 2011 : 18:30:36 Kirsty, Just had a thought, I'm not sure if this still applies if an IPA has been given. Can an expert advise please?

Posted - 24 May 2011 : 18:26:51 Hi Kirsty. If your redundancy occurs after discharge, any monies can be kept by you.

Posted - 24 May 2011 : 18:11:31 Hi. I'm new to all this. If redundancy comes after discharge can funds be taken then. |

Posted - 27 April 2011 : 20:52:19 I think that's very harsh - even in an IVA you are able to keep 6 months of redundancy pay.

Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.
Last IPA payment made on 28th June 2010 - it's over at last! |

Posted - 27 April 2011 : 19:44:36 yes they can.
What would you live on? The same as anyone else who did not have a redundancy payment, you either get another job or you claim benefits |

Posted - 26 April 2011 : 21:35:22 They can take anything that you get in compensation for losing your job, if your reducndancy date it before discharge, it matters not if it is voluntary or not |
