Posted - 01 May 2011 : 16:04:15 Not sure if anyone can help but desperately need some advice. I have found out that my father has major debt problems, he lost his home last year and he and mum have been living in a caravan since. The problem is that I have recently agreed to open a joint bank account with him as he is effectively homeless and since then I have received letters from people he owes money to. He is obviously having problems but will not talk about them to anyone. I have brought up the possibility of declaring bancruptcy but he is a pensioner and is worried that he would lose the caravan. It seems to me that he must do something as his creditors won't just simply disappear. What suggestions could I put forward to him? |

Posted - 01 May 2011 : 18:45:22 If you have a joint bank account with him then you are jointly liable for any overdraft on that account, but bailiffs for his other personal debts can not come after you.
He really needs to speak to someone to sort it all out, but I know that may be difficult if he doesn't want to. I'm not sure what to suggest. He can visit any CAB or give him an expert's number from here and tell him to just ring for a chat.

Posted - 01 May 2011 : 17:47:42 Hi Viki, thanks for replying. I'm unsure of his actual debt as he is very secretive about it. I don't think even my mother knows, however I believe it to be over 50K. He bought the caravan outright as far as I am aware and I bought him a car to tow it as he had to get rid of the one he had, again through not paying. He moves from one caravan site to another every month, he has told me that it is cheaper to do this so would not have a local CAB, although he had been in touch with his local CAB before he lost his home. Unfortunatley I don't know where this led to but must presume the outcome was negative. As his creditors are now writing to my address would I have to get involved? Do I have to prove somehow that he does not live here if the bailiffs show up? I am very worried that I will get sucked into something I have had nothing to do with.

How much debt does he have? Does he own the caravan or is it on finance?
There are so many questions and possibly lots of options for him so it's hard to advise, but try and get him to contact an expert on here for an informal chat or visit his local CAB.
