hello, i am after some information for my sister and her partner, its all a bit complicated but really need some advice. my sisters partner declared himself bankcrupt in feb, at the time he was not living with my sister, he moved back in with her ( and their 3 children)in april. they completed the soa and he had his telephone call with the OR. my sister does not work due to none of the children being of school age and he only brings home £310 a week, their other income is child benefit and tax credits. it works out with what they want him to pay back they are going to be on the bread line, there will be no money for xmas/birthdays, all the normal things that you spend on children. this debt is not her s and yet she and the children are going to suffer, is this correct?
are we able to access the calculations that they got this figure from?
they really are not being very helpful, look forward to some proper advice from someone in the know.

hi,
we contacted the insolvency service today to ask for a copy of the calculations but were told no they think it would be inappropiate for us to view them???
can anyone please advise.

If the children are pre school age they really won't miss out by not having money spent in them for Christmases & birthdays.
Tax credit is income but against that will be food, clothing etc for them so there shouldn't be any surplus there. |

hi,
thank you for replying. they are asking for £80 a week.
i know presents etc are not essentials but when its your children and its not your debt it is very frustrating that they can take everything away from you. Before he moved back in she was on benefits and was totally in control of her money,she was able to save for the kids birthdays etc. the only money she receives now is tax credits and child benefit and they are taking that as income. although according to the last letter they sent her own personal expenses will not be taken into account - how does this work???
i will get her to contact them tomorrow so we can have a full breakdown of how these figures were calculated.

you are allowed to see the figures yes, but be warned, if their argument is that you cant afford presents they are unlikely to get sympathy, they are not really essentials, the budget they set is supposed to be about things like rent, food bills etc.
Having said that their level of income does seem to be quite low, how much are they being asked to pay |
